(District III) These improvements are approximately located near Creek View Place and Casablanca Street (Wendt Ranch). " .. f 'y�' �C (" , 6 SUBJECT: Accepting completion of landscape improvements for Subdivision Agreement (Right-of-Way Landscaping) for Subdivision 96-08002, for project being developed by Shapell Industries of'Northern California, Danville/Tassajara area. (District III) DATE: May 20, 2008 PAGE: 2 NOW THEREFORE BE IT RESOLVED that the landscape improvements have been COMPLETED as of May 20, 2008 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement (Right-of-Way Landscaping): DATE OF AGREEMENT NAME OF SURETY March 26, 2002 American Casualty Company of Reading, Pennsylvania BE IT FURTHER RESOLVED the payment. (labor and materials) surety for $209,800.00, Bond No. 929206143 issued by the above surety.be RETAINED for the six month lien guarantee period until November 20, 2008, at which time the Clerk of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED that the Right-of-Way Landscaping improvements along Creek View Place, Knolls Creek Drive, Casablanca Street, Blue Spur Circle, Carmen Way, Carmen Court, Ariel Drive, Vanessa Way and Monte Albers Way are ACCEPTED AS COMPLETE. Upon acceptance, Shapell Industries, Inc. shall retain the landscape improvements for maintenance in accordance with the Landscape Maintenance Agreement approved by the Board of Supervisors on April 24, 2007. BE IT FURTHER RESOLVED that there is no warranty and maintenance period required, and the Public Works Director is AUTHORIZED to refund the $4,196.00 cash security for performance (Auditor's Deposit Permit No. 382773, dated March 7, 2002) plus interest in accordance with Government Code Section 53079, if appropriate, to Shapell Industries of Northern California, pursuant to the requirements of the Ordinance Code; and the Subdivision Agreement (Right of Way Landscaping) and surety bond, Bond No. 929206143, dated February 28, 2002 are exonerated. All deposit permits are on file with the Public Works Department.
