RESOLUTION NO. 2008/
SUBJECT: Accepting completion of landscape improvements for Subdivision Agreement
(Right-of-Way Landscaping) for Subdivision 04-08905, Alamo area. (District III)
These improvements are approximately located along Stone. Valley Road and Golden
Grass Drive.
The Public Works Director has notified this Board that the Right-of-Way Landscaping
improvements for Subdivision 04-08905, have been completed with the exception of minor
deficiencies (Street Trees), for which a $32,000.00 Deficiency Bond #070004770 Dated January
25, 2007 shall be retained to insure the installation of the remaining street trees, as provided in
the Subdivision Agreement (Right-of-Way Landscaping) with Davidon Homes, heretofore
approved by this Board;

SUBJECT: Accepting completion of landscape improvements for Subdivision Agreement
(Right-of-Way Landscaping) for Subdivision 04-08905, Alamo area. (District III)

NOW THEREFORE BE IT RESOLVED that the landscape improvements have been
COMPLETED as of May 20, 2008, thereby establishing the six-month terminal period for the
filing of liens in case of action under said Subdivision Agreement (Right-of-Way Landscaping):

BE IT FURTHER RESOLVED the payment (labor and materials) surety for
$130,150.00, Bond No. 070004770 issued by the above surety be RETAINED for the six month
lien guarantee period until November 20, 2008,, at which time the Clerk of the Board is
AUTHORIZED to release the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the Right-of-Way Landscaping improvements along
Stone Valley Road and Golden Grass Drive are ACCEPTED AS COMPLETE. Upon
Acceptance by the Board of Supervisors, the Homeowners Association, shall retain the landscape
improvements for maintenance.
BE IT FURTHER RESOLVED that there is no warranty and maintenance period
required. The Public Works Director is AUTHORIZED to retain the $2,603.00 cash security
for performance (Auditor's Deposit Permit No. 478346, dated February 15, 2007) and the
deficiency Bond rider No. 070004770, dated January 25, 2007 for $32,000.00 until release by
this Board.
All deposit permits are on file with the Public Works Department.
