HomeMy WebLinkAboutRESOLUTIONS - 06032004 - 94-75 /00 TIM BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on February 1, 1994 by the following vote: AYES: Supervisors Smith, Bishop, McPeak,, Torlakson and Powers NOES: None ABSENT: None AJ3SrA]N: None RESOLUTION NO 94/75 SUBJECT: Approval of a Substitute Subdivision Agreement, Subdivision 6935, Oakley Area. The following document was presented for Board approval this date: A substitute Subdivision Agreement with ATC Realty Sixteen Inc., subdivider, whereby said subdivider agrees to complete all improvements as required in said Subdivision Agreement within one year from the date of said agreement. Said document was accompanied by the following: Security to guarantee the road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows. a. Cash deposit (Auditor's Deposit Permit No. 237231, dated January 12, 1994) in the amount of$10,200 made by ATC Realty Sixteen, Inc. b. Additional security in the form of an instrument of credit dated August 6, 1993, and issued by Wells Faro Bank with ATC Realty Sixteen Inc. as principal, in the amount of$1,020,500 for faithful performance and $510,250 for labor and materials. NOW THEREFORE BE IT RESOLVED that said substitute Subdivision Agreement is APPROVED. BE IT FURTHER RESOLVED that the Subdivision Agreement with Oakely Associates, as approved by the Board on September 11, 1990, is TERMINATED, the improvement security bond with Developers Insurance Company is EXONERATED and the Public Works Director is AUTHORIZED to refund the cash deposit (Auditor's Deposit Permit No. 178072, dated August 24, 1990) in the amount of $10,200, plus interest in accordance with Government Code Section 53079, if appropriate, to Oakley Associates.
