Resolution of Summary Vacation

The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street no longer required for
street purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and
Highways Code, commencing with Section 8330. 0
This vacation request is for a portion of 5th Street, located in the Rodeo area. A
description of the portion to be vacated is attached hereto as Exhibit"A"and incorporat-
ed herein by reference.
This vacation request is for an excess right of way not required for street or
highway purposes. (S. & H. Code Section 8334).
This Board hereby FINDS that the proposed vacation will not have a significant
effect on the environment, and that it has been determined to be exempt from the
California Environmental QualityAct under State CEQ4 guidelines Section 15061 (b) (3).
This Board DIRECTS the Director of Community Development to file a Notice of
Exemption with the County Clerk, and DIRECTS the Public Works Director to arrange for
payment of the $25-00 handling fee to the County Clerk. The Planning Commission
having considered their general plan, FINDS pursuant to Government Code Section
65402 in accordance with its Resolution No. 81/522; this vacation is minor in nature and
therefore exempt from general plan conformance.
This Board declares that the hereinabove described proposed vacation area is
HEREBY ORDERED VACATED subject to any reservation and exception described in
attached Exhibit "A7. From and after the date this Resolution is recorded, the portion
vacated no longer constitutes a public highway,

Real property in an unincorporated area of Contra Costa County, California, being aportion of Fifth
Street shown on the Map of Rodeo filed February 5, 1882 in Book D of Maps at page 91, described
as follows:
A 60.00 feet wide strip of land, the north line of which is describedas follows:
Beginning at the southeast corner of Block 28W (D M 91), also being the intersection of the west
right ,of way line of Garretson Avenue and the north right of way line of Fifth Street; thence from the
Point of Beginning, along said north line of Fifth Street, south 79008'0011 west 141 feet, more or less,
to its terminus at the most southern corner of said Block 28W. '-
Bounded on the east by the west right of way line of Garretson Avenue, and bounded on the west
by the southwest boundary of said Map of Rodeo (D M 91)0
Containing an area of 7,440 square feet (0.171 acre) of land, more or less*
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the*Streets and Highways
Code, the easement and right at any time, or from time to time, to construct, enlarge, maintain,
operate, replace, remove and renew those existing and in place utilities, as of the date of recording
this instrument, in, upon, over and across any highway or part thereof proposed to be vacated,
including access to protect the property from all hazards, in, upon, and over the area herein before
described to be vacated.
