HomeMy WebLinkAboutRESOLUTIONS - 06032004 - 94-18 THE BOARD OF SUPERVISORS CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on January 11, 19949 by the following vote: AYES: Supervisors Bishop, McPeak, Torlakson and Powers NOES: None ABSENT: Supervisor Smith RESOLUTION NO. 94/ 18 (Gov. Code § 25526.5) SUBJECT: Property Exchange Livorna Heights Road Project No. 0662-6U4320 Alamo Area The Board of Supervisors of Contra Costa County RESOLVES THAT: A portion of the land acquired for the Livorna Heights Road realignment project, as described in Exhibit"N'attached hereto, is excess and no longer necessary for County or other public purposes. A portion of is land owned by the Wald Family Trust, as described in Exhibit "B" attached hereto, s required by the County to relocate the Wald9 s access to Livorna Heights Road in the area described in Exhibit 'IN' attached hereto, The Board hereby APPROVES the exchange of all the county's right, title, and interest in and to said excess land pursuant to Government Code Section 25526.5 and the Board Chair Is hereby AUTHORIZED to execute a Grant Deed to the Leonard and Florence Wald Trust for the property described in Exhibit 'IN' attached hereto. The County Real Property Division is DIRECTED to cause said deed to be delivered to the grantee together with a copy of this Resolution, The Grant Deed from Leonard 0. and Florence E.Wald,Trustees,the Wald Family Trust, dated December 20, 1993, for the land described in Exhibit "B" is hereby ACCEPTED and the County Real Property Division is DIRECTED to have said deed recorded in the Office of the County Recorder. This activity Is not subject to the California Environmental Quality Act pursuant to Section 15061(b}(2} of Chapter 3 of CEQA Guidelines. It can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment. This Board DIRECTS the Director of Community Development to file a Notice of Exemption with the County Clerk, and DIRECTS the Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk. The Planning Commission having considered their general plan, FINDS pursuant to Government Code Section 65402 in accordance with its Resolution No. 81/522; this exchange is minor in nature and therefore exempt from general plan conformance.
