WHEREAS, Section 99 of the Revenue and Taxation Code provides that a
jurisdictional change resulting from a special district providing one or more
services to an area where such services have not been provided previously
shall not become effective if one or more affected special districts involved
in the property tax exchange negotiation fails to adopt a resolution agreeing
to a transfer; and
WHEREAS, the Board of Supervisors shall determine the property tax
exchange for each affected district that fails to adopt a resolution agreeing
to a property tax transfer for the annexing district; and
WHEREAS, the Stonebridge Creek Boundary Reorganization (LAFC 94-3)
involves annexation of territory to the Central Contra Costa Sanitary
District and the East Bay Municipal Utility District for which property tax
exchange is determined by a previously approved master property tax exchange
agreement; and
WHEREAS, the reorganization also involves annexation of territory to
County Service Area R-7A (CSA R-7A) which is not subject to an existing
property tax exchange agreement.
NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA
COSTA COUNTY DOES HEREBY DETERMINE that there shall be no transfer of
property tax to CSA R-7A as a result of this reorganization. The terms of
this property tax exchange agreement shall be effective for the fiscal year
for which the State Board of Equalization makes the tax rate area changes for
this jurisdictional change and shall apply in subsequent years unless changed
by the mutual agreement of affected agencies or subsequent jurisdictional
changes. This resolution does not change the property tax revenues accruing
to other agencies serving the subject territory or the affected agencies
right to collect taxes for existing bonded indebtedness. The property tax
exchange agreement discussed above shall apply to affected territory as
submitted or revised by the Local Agency Formation Commission.
