HomeMy WebLinkAboutRESOLUTIONS - 06032003 - 70-168 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Opposing ) the Passage of Assembly RESOLUTION NUMBER 70/168 Bill Number 278. WHEREAS Assembly Bill Number 278 has been introduced in the 1970 Session of the California State Legislature; and, WHEREAS said bill provides that taxpayers may institute court action on a trial de novo basis for review of property assessments subsequent to determinations made by a county board of equalization or assessment appeals board.; and. WHEREAS under current procedures any taxpayer may review his assessment with the Office of the County Assessor to ascertain the basis on which his valuation was set and an adjustment may be made if any error has been made; and WHEREAS any taxpayer may appeal to the county board, of equalization or assessment appeals board and obtain an adjustment in his valuation if he can demonstrate that such an adjustment is equitable; and WHEREAS in most cases it is found that the disturbing factor in connection with valuations is not the amount of the assessments but the amount of tax levies which in turn are contin- gent upon high tax rates particularly those of school districts; and WHEREAS it has been recognized that property tax relief is a matter of urgency and that additional revenues to support local government activities should. be derived from sources other than property taxes; and WHEREAS local property valuation procedures have been continuously improved in the direction of producing uniform assess- ment and the effect of Assembly Bill Number 278, if enacted into law, will only be the initiation of tax litigation cases with a resultant increased burden on the court system, with complications related. to holding property tax payments in trust accounts, with significant legal costs to both taxpayers and counties , and. few if any assessment adjustments other than those which can be made--if justifiable--under existing procedures; NOW, THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA, CALIFORNIA RESOLVED that it expresses strong opposition to the passage of Assembly Bill Number 278 and requests its representatives in the California State Legislature to worm vigorously to prevent the passage of said bill.
