SUBJECT: Acceptance oftbe Subdivision Agreement and Approval of a quitclaim dead for Subdivision
MS 68-90,Brentwood area.
On December 6, 1994 the Board of Supervisors approved the Parcel Map for Subdivision MS 68-90
(165 PM 40,December 12, 1994)and accepted a grant deed of development rights for Parcels A,B,C, &D
ofthat subdivision from Wes and Shirley Tilton(O.R. Series 94-292420,December 12, 1994). In exchange
for those developments rights the following documents were presented for Board approval this date:
1. A Subdivision Agreement with Jeffery J. and Sara L.Tamayo,subdivider,whereby said subdivider
agmes to complete all improvements as required in said Subdivision Agreement within one year from
the date of said agreement. Accompanying said Subdivision Agreement is security guaranteeing
completion of said improvements as follows:
A. Cash Deposit
Deposit amount: $1,000
Deposit made by: Jeffery and Sara Tamayo
Auditors Deposit Permit No. and date: 300107(August 14, 1997)
B. Letter of Credit
Financial Institution: Bank of Agriculture&Commerce
Letter of Credit Number and Date: #4135,August 12, 1997
Performance Amount: $32,500
Labor&Materials Amount: 516,750
Principal: Jeffery J. and Sara L.Tamayo
II. A Quitclaim Dad of Development rights,whereby Contra Costa County releases the development
rights for Parcels A,B, C,and D of Subdivision MS 68-90 to Jeffery J.and Sara L.Tamayo.
NOW THEREFORE BE IT RESOLVED that said subdivision agreement is ACCEPTED and;
IT IS BY THE BOARD ORDERED that the Chair is AUTHORIZED to execute a"Quitclaim Deed„
of the development rights for parcels A, B, C, and D of Subdivision MS 68-90 to Jeffery J. and Sara L.
Tarnayo.
Alt deposit permits are on file with the Public Works Department.

QUITCLAIM DEED OF DEVELOPMENT RIGHTS
For valuable consideration, specifically assurance of construction of a 16-foot all-weather road to
County private road standards, receipt of which is hereby acknowledged, County of Contra Costa,
a political subdivision of the State of California, hereby remises, releases and forever quitclaims to
Jeffery J. and Sara L. Tamayo, all of its right, title and interest in the real property; specifically
"Development Rights"as defined in the deed to the County of Contra Costa, recorded December 12,
1994,in Official Records, Series 94-292420, Contra Costa County Records, State of California; over
those certain parcels of land situated in Contra Costa County, being parcels A, B, C and D of
Subdivision MS 68-90 filed December 12, 1994,in Book 165 of Parcel Maps, Page 40, Contra Costa
County Records, State of California, more particularly described in Exhibit "A" attached hereto and
made a part hereof.
No transfer tax due;this is a Quitclaim of Development Rights only.

heretofore levied on the property included in said map and that the 1996197 tax lien has
been paid in full and that the 1997/98 tax lien, which became a lien on the first day of
January 1997, is estimated to be$2,200:
