HomeMy WebLinkAboutRESOLUTIONS - 05072002 - 2002-006 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on (date), by the following vote: AYES: UILKEMA, GERBER, DeSAULNIER, GLOVER and GIOIA NOES: NONE ABSENT: NONE ABSTAIN: NONE SUBJECT: In the Matter of Destroying Resolution No. 2002/b - Records and Files Damaged in the Fire on May 1, 2002 WHEREAS, the County Department of Human Resources experienced a fire on May 1, 2002 which damaged certain records and files pertaining to employment applications for exams where the eligible list has expired. WHEREAS, the damaged records and files are inactive records and currently serve no County purpose and any County appeal procedures have expired. WHEREAS, the damaged records and files cannot be retained in the normal manner due to charring, water damage and a strong odor of smoke. WHEREAS, the damaged records and files range from four months to five years old, with the majority of the records being more than two years old. WHEREAS, the damaged records and files were not prepared or received pursuant to a state statute or county charter. WHEREAS, the State of California Government Code Section 26202 authorizes the Board of Supervisors to approve destruction of documents which are more than two years old and which were not prepared or received pursuant to a state statute or county charter. WHEREAS, the State of California Government Code Section 26205.1 authorizes the Board of Supervisors to approve destruction of nonjudiciai public records and documents upon adoption of a resolution. The Contra Costa Board of Supervisors in its capacity as Governing Board of the County of Contra Costa, and all districts of which it is the ex-officio Governing Board, RESOLVES THAT: The Director of Human Resources may destroy documents and files actually damaged in the fire of May 1, 2002.
