HomeMy WebLinkAboutRESOLUTIONS - 04032001 - 2001-143 T •i THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Passed and Adopted this Order on April 3, 2001 by the following vote: AYES: Supervisors Gioia, Gerber, DeSaulnier, Glover & Uilkema NOES: None ABSENT:None ABSTAIN:None RESOLUTION NO. 2001/143 (Streets and Highways Code § 760) SUBJECT: AUTHORIZATION UNDER STREETS AND HIGHWAYS CODE SECTION 760 FOR COUNTY TO ACQUIRE PROPERTY FOR STATE HIGHWAY PURPOSES. STATE ROUTE 4 EAST WIDENING PROJECT. The Board of Supervisors of Contra Costa County, California, by vote of four-fifths or more of its members, RESOLVES that: Pursuant to Government Code section 25350.5 and Streets & Highways Code section 943, Contra Costa County in conjunction with the Contra Costa Transportation Authority (CCTA) and the State of California Department of Transportation (Caltrans) intend to construct a road project in the Pittsburg area, specifically the State Route 4 East Widening Project. This project, which is sponsored by CCTA, will widen State Route 4 to accommodate an additional mixed-flow land and one high occupancy vehicle lane in each direction within the 3.6 kilometer (2.2 mile) long State Route 4 corridor between Railroad Avenue and Loveridge Road. Caltrans has recommended that the County acquire real property or interests needed for the State Route 4 East Widening Project and has asked that the County adopt this resolution. This Board recognizes that the acquisition of property or interests for State highway purposes will promote the interests of the County and is a necessity. The County of Contra Costa is hereby authorized to acquire in the name of the State or the County any titles, easements and rights of way in and to real property or interest(s) therein needed for the State Route 4 East Widening Project. This resolution is the only preliminary procedure required prior to the acquisition of such property or interest. However, in the event that eminent domain proceedings are required, the County will adopt a separate resolution which satisfies the requirements of Article 2 (commencing with section 1245.210) of Chapter 4, Title 7, Part 3 of the Code of Civil Procedure.
