THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on June 3, 1997, by the following vote:
AYES: Supervisors Rogers, Uilkema, Gerber, Canciamilla, DeSaulnier

RESOLUTION NO.: 97/279
SUBJECT: Completion of Improvements, and Declaring Certain Roads as County Roads, Sub.
7945, Oakley area.
The Public Works Director has notified this Board that the improvements in Subdivision 7945
have been completed as provided in the Subdivision Agreement with BPH Homebuilders, 1995 L.P.,
heretofore approved by this Board in conjunction with the filing of the Subdivision Map.
NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of June 3, 1997, thereby establishing the six-month terminal period for the filing of liens in case
of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment(labor and materials)surety for$122,450, Bond
No. 1375356 issued by Insurance Company of the West, be RETAINED for the six month lien
guarantee period until December 3, 1997, at which time the Clerk of the Board is AUTHORIZED
to release the surety less the amount of any claims on file.

2 -BE IT FURTHER RESOLVED that Daniel Drive, Nutmeg Drive, Thyme Court, and
Mercedes Court the hereinafter described roads, as shown and dedicated for public use on the Final
map of Subdivision 7945 filed June 25, 1996, in Book 387 of maps at page 36, Official Records of
Contra Costa County, State of California, are ACCEPTED and DECLARED to be County Roads.

by HPH Homebuilders, 1995 L.P., and the performance/maintenance surety for$242,450, Bond No.
1375356 issued by Insurance Co. of the West, be RETAINED pursuant to the requirements of
Section 94-4.406 of the Ordinance Code until released by this Board.
