Adopted this Resolution on June 25, 1996 by the following vote:
AYES: Supervisors Rogers, Bishop, DeSaulnier, Torlakson, Smith

RESOLUTION NO.: 96/280
SUBJECT: Completion of Improvements, Subdivision MS 44-87, Knightsen Area.
The Public Works Director has notified this Board that the improvements in Subdivision
MS 44-87 have been completed as provided in the Subdivision Agreement with Don Davis
heretofore approved by this Board in conjunction with the filing of the Subdivision Map.
NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of June 4, 1996 thereby establishing the six-month terminal period for the filing of liens in case
of action under said Subdivision Agreement:

September 25, 1990 $14,000 CASH BOND (DP 178898, dated
September 13, 1990)
BE IT FURTHER RESOLVED that the $7,500 cash security for labor and materials
(Auditor's Deposit Permit No. 178898, dated September 13, 1990) deposited by Eagle Landscape
Corp./Don Davis be RETAINED for the six-month lien guarantee period until December 4, 1996,
at which time the Public Works Director is AUTHORIZED to refund the cash security less the
amount of any claims on file.

BE IT FURTHER RESOLVED that there is no one year warranty period required, and the
Public Works Director is AUTHORIZED to refund the $1,000 cash security for performance
(Auditor's Deposit Permit No. 178898, dated September 13, 1990) and the $14,000 cash bond
for faithful performance (and deposit permit no. 178898, dated September 13, 1990), plus interest
in accordance with Government Code Section 53079, if appropriate, to Eagle Landscape
Corp./Don Davis pursuant to the requirements of the Ordinance Code.
