SUBJECT: Approval of the Final Map, Subdivision Agreement, Road Improvement Agreement
(RA 1033),Drainage Improvement Agreement,Right of Way Landscape Agreement,
Abandonment of Offer of Dedication for Drainage Purposes, Abandonment of Offer
of Dedication for Slope&Drainage Easements, Abandonment of Offer of Dedication
for Road Purposes, and Abandonment of Relinquishment of Abutter's Rights for
Subdivision 7838, Bay Point area. File No. 0651-6L-0072, CDD-CP #96-33
The following documents were presented for Board approval this date:
The Final Map of Subdivision 7838, property located in the Bay Point area, said map having
been certified by the proper officials;
A Subdivision Agreement with Kaufman & Broad of Northern California, Inc., subdivider,
whereby said subdivider agrees to complete all improvements as required in said Subdivision
Agreement within one year from the date of said agreement;
Said document was accompanied by:
I. Security to guarantee the completion of road and drainage improvements as required
by Title 9 of the County Ordinance Code, as follows:
A. Cash deposit (Auditor's Deposit Permit No. 277495, dated May 2, 1996) in
the amount of$6,050 made by Kaufman&Broad of Northern California, Inc..
B. Additional security in the form of a corporate surety bond dated April 23,
1996, and issued by American Casualty Company of Reading Pennsylvania
(Bond No. 142136252) with Kaufman &Broad of Northern California, Inc.
as principal, in the amount of$598,450 for faithful performance and $302,250
for labor and materials.
II. Letter from the County Tax Collector stating that there are no unpaid County taxes
heretofore levied on the property included in said map and that the 1995/96 tax lien
has been paid in full and the 1996/97 tax lien, which became a lien on the first day of
March, 1996, is estimated to be $10,700;
III. Security to guarantee the payment of taxes as required by Title 9 of the County
Ordinance Code in the form of a surety bond, No. 142136218, issued by American
Casualty Company of Reading Pennsylvania with Kaufman& Broad of Northern of
California, Inc. as principal, in the amount of$10,700 guaranteeing the payment of
the estimated tax;
A Road Improvement(Evora Road at Driftwood Drive) Agreement with Kaufman& Broad
of Northern California, Inc., subdivider, whereby said subdivider agrees to complete all road
improvements as required in said Road Improvement Agreement within one year from the date of said
agreement;
Said document was accompanied by:
I. Security to guarantee the completion of road and drainage improvements as required
by Title 9 of the County Ordinance Code, as follows:
A. Cash deposit (Auditor's Deposit Permit No. 277495, dated May 2, 1996) in
the amount of$7,200 made by Kaufman&Broad of Northern California, Inc.
SUBJECT: Approval of the Final Map, Subdivision Agreement, Road Improvement Agreement 0.3
(RA 1033), Drainage Improvement Agreement,Right of Way Landscape Agreement,
Abandonment of Offer of Dedication for Drainage Purposes, Abandonment of Offer

B. Additional security in the form of a corporate surety bond dated April 23,
1996, and issued by American Casualty Company of Reading Pennsylvania
(Bond No. 142136249) with Kaufman & Broad of Northern California, Inc.
as principal, in the amount of$716,000 for faithful performance and $361,600
for labor and materials.
A Drainage Improvement Agreement with Kaufman & Broad of Northern California, Inc.,
subdivider, whereby said subdivider agrees to complete all road improvements as required in said
Drainage Improvement Agreement within one year from the date of said agreement;
Said document was accompanied by:
I. Security to guarantee the completion of drainage improvements as required by Title
9 of the County Ordinance Code, as follows:
A. Security in the form of a corporate surety bond dated May 1, 1996, and issued
by American Casualty Company of Reading Pennsylvania (Bond
No. 142136364) with Kaufman & Broad of Northern California, Inc. as
principal, in the amount of$1,300,000 for faithful performance and $650,000
for labor and materials.
A Right of Way Landscape Agreement with Kaufman & Broad of Northern California, Inc.,
subdivider, whereby said subdivider agrees to complete all Right of Way Landscape Improvements
as required in said Right of Way Landscape Agreement within one year from the date of said
agreement;
Said document was accompanied by:
I. Security to guarantee the completion of Right of Way Landscape Improvements as
required by Title 9 of the County Ordinance Code, as follows:
A. Cash deposit (Auditor's Deposit Permit No. 276764, dated April 17, 1996)
in the amount of$1,000 made by Kaufman & Broad of Northern California,
Inc.
B. Additional security in the form of a corporate surety bond dated April 4,
1996, and issued by American Casualty Company of Reading Pennsylvania
(Bond No. 142135800) with Kaufman&Broad of Northern California, Inc.
as principal, in the amount of$172,468 for faithful performance and $86,734
for labor and materials.
The Director of Community Development having reported that: the Abandonment of Offer
of Dedication for Drainage Purposes(Book 1859 OR 755), the Abandonment of Offer of Dedication
for Slope & Drainage Easements (Book 7293 OR 217 & 223), the Abandonment of Offer of
Dedication for Road Purposes (Book 18859 OR 752), and the Abandonment of Relinquishment of
Abutters Rights (Book 18864 OR 752) are approved.
All deposit permits are on file with the Public Works Department.
NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions
for its design and improvement, is DETERMINED to be consistent with the County's general and
specific plans;

BE IT FURTHER RESOLVED that said Abandonments are APPROVED.
BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not
accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as
dedicated to public use.
BE IT FURTHER RESOLVED that said Subdivision Agreement, Road Improvement
Agreement(RA 1033),Drainage Improvement Agreement, and Right of Way Landscape Agreements
are also APPROVED.
BE IT FURTHER RESOLVED that the Board hereby FINDS that the activity, Abandonment
of Slope and Drainage Easements will not have a significant effect on the environment, and
DETERMINES that the activity is exempt from the requirements of the California Environmental
Quality Act (CEQA) pursuant to Article 5, Section 15061 (b) (3) of the CEQA Guidelines, and
DIRECTS the Director of Cummunity Development to file a Notice of Exemption with the County
Clerk and DIRECTS the Public Works Director to arrange for payment of the $25.00 handling fee
to the County Clerk for filing the Notice of Exemption.
