RECOMMENDATION:
APPROVE the Side Letter with the Contra Costa County Employees' Association, Local No. 1
allowing for the continuation of safety retirement benefits for Probation Department employees
in exchange for a two percent reduction in prospective pay equity salary adjustments and ratify
Leslie Knight's (Director of Human Resources) signing of the Side Letter on behalf of the County
. BACKGROUND:
In 1989, a number of employees of the Probation Department who were members of Local No.
1 sought safety membership in the retirement system. At that time, the law provided authority
for the County to offer safety retirement to certain Probation Department employees, but did not
allow the County to require the affected employees to pay all or a part of the increased employer
costs that could result from participation in the Safety Retirement Program. In 1990, the
Legislature amended Government Code Section 31639.9 and authorized the Board of Supervisors
to meet and confer with recognized employee organizations to allow certain Probation Department
employees to become safety members of the retirement system, including authorizing employees
to pay all or part of the employer's increased retirement contributions resulting from the
employees becoming safety retirement members. On January 8, 1991, the Board of Supervisors
by resolution, made the provisions of Section 31639.9 effective in Contra Costa County.
On November 14, 1989, in anticipation of the amendment to Government Code Section 31639.9,
the Board approved a side letter with Local No. 1 regarding the possible extension of safety
retirement membership for eligible Probation Department employees represented by Local No.
1. On December 14, 1989, the same provisions were extended to eligible management employees
in the Probation Department. The agreement provided a one-time election into the safety
retirement system for eligible Probation Department employees on the condition that the additional
costs of safety membership would be borne by the participating employees. The County recovered
the costs through payroll deductions for each employee whose safety membership costs exceeded
