HomeMy WebLinkAboutRESOLUTIONS - 04111995 - 95-156 2.4 6 j= Contra IN THE BOARD OF SUPERVISORS _ Costa OF County CONTRA COSTA COUNTY, CALIFORNIA W SUBJECT: In the Matter of the Evaluation of the ) Tri-Valley Transportation Plan/Action Plan ) Proposal for Adoption, January 1995 ) RESOLUTION NO. 95/156 The Board of Supervisors of Contra Costa County RESOLVES THAT: (01) WHEREAS, the Measure C-1988 Growth Management Program requires Action Plans for Routes of Regional Significance to include adopted traffic service objectives that use a quantifiable measure of effectiveness and include a target date for attaining the objective;' (02) WHEREAS, adopted traffic service objectives should be consistent with the actions proposed in the Action Plans, i.e., it should be reasonable to expect that if actions are implemented, the objectives will be achieved;2 (03) WHEREAS,the Tri-Valley Transportation Plan/Action Plan,Proposal for Adoption (Action Plan) traffic service objectives are not consistent with the actions it proposes3; (04) WHEREAS, this inconsistency would require the Board of Supervisors to obtain approval by the Regional Transportation Planning Committee to amend the Action Plan prior to making a decision on a general plan amendment that has been under review by the Board of Supervisors since 1991,4 thereby allowing other local jurisdictions to preempt the County's land use decision; (05) WHEREAS,Measure C-1988 compliance requirements cannot preempt local land use decisions or require cities to accept unwanted construction projects within their boundaries;` (06) WHEREAS, it is the intent of the Board of Supervisors not to limit its land use authority through the Action Plan process, particularly for land use decisions currently under review by the Board of Supervisors;7,8 (07) WHEREAS, the Board of Supervisors finds that the Action Plan traffic service objectives are desirable where they are similar to the traffic level of service standards for intersections identified in the Dougherty Valley Settlement Agreement and where consensus actions are identified to meet such traffic service objectives, and is committed to identify consensus actions that will meet such traffic service objectives;9 (08) WHEREAS, the Board of Supervisors finds that a consensus has not been reached with the Town of Danville and the City of San Ramon on the actions to be implemented in order to meet the traffic service objectives, and that further cooperation among local jurisdictions is needed before these traffic service objectives can be adopted as shown in the Action Plan;10 and (09) WHEREAS, the Board of Supervisors understands that compliance with the Action Plan is tied only to local implementation of action policies, and that one locality cannot be judged ineligible for Local Street Maintenance and Improvement Funds because of the unwillingness of another locality to participate in the process." B Contra Costa Board of Supervisors,Resolution 94-387, July 26, 1994. 9 Contra Costa Board of Supervisors, Resolution 94-385, July 26, 1994. 10 TVTC, op.cit., p. 232 " CCTA, op.cit., pp. IG-27-28. 95/156 (01) NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of Contra Costa County that the County shall: A. agree to the Traffic Service Objectives and undertake good faith efforts to implement the actions as they are specified in the Tri-Valley Transportation Plan/Action Plan, as revised in Exhibit A to this Resolution; (See Addendum to 2.4a for amendments by the Board) B. avoid a conflict with the Town of Danville and the City of San Ramon by continuing, in good faith, cooperative multi jurisdictional transportation planning, including further technical effort and policy development; C. prior to making a decision on development proposals in the Tri Valley area that have traffic impacts on Regional Routes in the Town of Danville and the City of San Ramon, consult with the councils of these jurisdictions in the evaluation of possible consensus actions to reduce traffic impacts to an acceptable level; D. In evaluating development proposals in the area that impact the intersections specified in the Dougherty Valley Settlement Agreement, continue to apply the level of service standards identified in that agreement to such development; and E. The actual level of development in Dougherty Valley shall be limited consistent with the terms and provisions of the Dougherty Valley Settlement Agreement. (02) BE IT FURTHER RESOLVED THAT the County will participate in a Tri Valley Transportation Council (TVTC) study on Regional Traffic Development Fee Study, provided that the study's scope of work is supported by all TVTC jurisdictions with a cost to the County not to exceed $10,000 to be funded by the County's Measure C-1988 return-to-source revenues; and (03) BE IT FURTHER RESOLVED THAT the County will participate in a TVTC study on growth management focused on resolution of projected traffic service objective violations identified by the Plan's Proposal for Adoption released in January 1995, provided that the study's scope of work is supported by all TVTC jurisdictions with a cost to the County not to exceed $5,000 to be funded by the County's Measure C- 1988 return-to-source revenues.
