Creation of the Byron XMniejgal Advisory jqouncil V4rsuant to the authority granted by Section 31010 of Ote California. :Government Code, the Byron, Municipal Town Advisory Council is hereby created. 2. 9,6mborshjp i19 Council shall consist of seven (7) members 'who 0�, all be residents of the Byron community (as described .x► Item 3 below) . The initial body of Council members shall be appointed by the Board of Supervisors of Centra Costa County upon the recommendation of the District V Supervisor. 3 . yon f,ommunity T}*a Byrom Community is that area contained within the aqundaries indicated on the attached map (Exhibit A) . 4 . tiia pf Office For the initial council the Board shall, by lot, select f,?4r (4) members who shall serve an initial term of four (4) years and three (3) members who shall serve an initial term of two (2) years. Upon completion of i"'111tial terms, subsequent council .members shall sexve four (4 ) year (staggered) terms . 5. Council 2Mtjee and PgX2rs e Council shall advise the Board of Supervisors ; on 1,iic use 'and planning matters affecting the community ax.. Byron and may represent the Byron community before the Board of Supervisors, the East County Regional F,linning Commission and the Zoning Administrator ! on such issues as land use, planning and sotiing. The Council may also represent the Byron Community before the Local Agency Formation Commission on proposed bokindary changes '-affecting the community. Thi Council may advise the Board on services -which are or: ,may be provided to the Byron Community `by' Contra CaFsta County or: other local governmental agencies. Such services include, but are not limited to, public h*with, safety, welfare, public works, and planning. The Council may also provide input and reports to the Board of Supervisors, County Staff or any County hearing, body on issues of concern to the Byron c0nmunity. it is understood that Council members serve in. an advisory capacity only and that the Board :of Skpervisors is the final decision making authority with respect to issues. concerning the Byron Community. The Council will not attempt to represent a County position to any outside- agency and will stake clear to any -such agency its position of service as an advisory body only. 6 . �tpensation Council tantembers will serve without compensation of any kind. Contra Costa County will not provide funding for tete payment of sleeting stipends or any expenses incurred by the Council. 7. staff and �rinancial Suoeort A. Contra Costa County shall provide no ongoing professional or clerical . staff support to . the Byron Municipal Advisory Council, nor will the County provide any funding for the Council's operating costs . B. County staff will provide the Council in a timely manner with information and reports on planning matters (proposed General Plan and toning changes, land use permits, variance and subdivision applications, etc. ) , transportation issues or projects, or any such matters which take place in, or will have an effect on, the Byron Community. LAPCO staff will notify the Council of any proposed boundary or sphere changes which nay impact the Byron community. 8. C25npil Operation within the parameters of this resolution, the Byron Municipal Advisory Council may organize itself and operate as it determines, but shall hold regular meetings at least monthly at an established time and location. Any such meeting may be adjourned to :.the next regular monthly meeting if there is no business to be transacted at that time. The Council 's meetings shall be conducted in accordance with the provisions of the Brown Act (Governatent Code Sectons 54950 ff,. ) , including the posting of meeting agendas . The Council will adopt bylaws (using the County's recently adopted ; standard MAC bylaws as a foundation) and will provide a copy of said bylaws to the office of the District V Supervisor. 9 . Council Establishment Not Subject to Vote The issue of the establishment of the Byron Municipal .Advisory Council spall not be an election item submitted to the voters of the Byron Co=mmunity. 10. ntxtre Bleptions The Community has requested an appointed Council at this time. However, the Con®unity intends to transition to an elected body at such time as funds for an selection be ame available. Any costs incurred as a result of such an election will be the responsibility of the Byron Community and will not be borne by Contra Costa County. 11 . Dissolution 2f Ccnncil The provisions of this resolution shall be of no further force and effect after June 1, 1998 and the Council will be dissolved on that date unless the Board of Supervisors has taken action to extend the Council's existence.
