HomeMy WebLinkAboutRESOLUTIONS - 04191994 - 94-204 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April =19 , 1994 , by the following vote: AYES: Supervisors Smith, DeSaulnier, Torlakson and Bishop NOES: None ABSENT: Supervisor Powers ABSTAIN: None In the Matter of Implementing ) a Parking Amnesty Program ) RESOLUTION NO. 94/-104 WHEREAS the responsibility for processing parking citations has been transferred statewide from the municipal courts to the local police agencies, as mandated by law; and WHEREAS delinquent citations must be removed from the Courts automated parking system and transferred to police agencies for subsequent collection efforts prior to discontinuing use of the Courts' system; and WHEREAS there are over 95,000 delinquent parking citations issued in Contra Costa County which have not been cleared; and WHEREAS unpaid parking citations after 30 days subject the vehicle owners to additional penalties and DMV holds on vehicle registration; and WHEREAS citizens who have outstanding parking citations tend to continue to disregard the law, which undermines the integrity of the legal process; and WHEREAS many citizens have expressed an interest in clearing their records but find that the penalties have become onerous and they are unable to pay both the penalties and late charges; and WHEREAS the Contra Costa County Municipal Courts intends to institute a parking amnesty program in order to reduce the number of delinquent citations prior to discontinuing use of the Courts' parking system and transfer of the remaining citations to the police agencies; and WHEREAS the full bail amount on delinquent citations in the Courts' parking system will be rolled back to the original bail amount during the amnesty program in accordance with Vehicle Code Section 40511 and Penal Code Section 1275; NOW THEREFORE IT IS RESOLVED that the Board of Supervisors of Contra Costa County SUPPORT the four Municipal Courts in implementing an amnesty period for outstanding parking citations that are subject to penalties and DMV holds; and IT IS FURTHER RESOLVED that the Courts' parking amnesty period will be conducted from April 1 through May 31, 1994.
