HomeMy WebLinkAboutRESOLUTIONS - 06041991 - 91-361 1-074 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this order on June 4, 1991 by the following vote: AYES: Supervisors Schroder, Torlakso.n, Powers NOES: None ABSENT: Supervisors Fanden, McPeak ABSTAIN: None SUBJECT: Amendment of Salary ) RESOLUTION NO. 91/361 Regulations Respecting ) Overtime ) Whereas the Board of Supervisors has enacted Resolution No. 83/1 , Section 12 of which contains provisions which are ambiguous; and Whereas the County Administrator has recommended amendment of Section 12 to eliminate this ambiguity; In its capacity as the governing board as the Board of Supervisors of the County of Contra Costa and as the governing board of .the Contra Costa County, Moraga, Orinda, Riverview, and West County Fire Protection Districts, and the County Flood Control and Water Conservation District, THE BOARD HEREBY RESOLVES: 1. Adoption of this resolution shall not delete, change, or modify in any way the provisions of current memoranda of understanding, deep class resolutions, or other resolutions providing for salaries or other terms and conditions of employment. 2. Adoption of this resolution is a clarification of existing practices and policies previously authorized by this Board. 3. Section 12 of Resolution No. 83/1 is amended to read as follows: SECTION 12 CONDITIONS OF EMPLOYMENT - OVERTIME 12.1 Overtime - Pay and Regulations. (a) Pay. Except as provided for by law or elsewhere by the Board of Supervisors, all overtime as defined in Section 8 shall be compensated: (1) if by compensatory time off, at one and one-half (12) hours for each hour of overtime worked, or (2) if by monetary compensation, at one and one-half (12) times the hourly equivalent of an employee's base salary rate. (b) Regulations - Compensatory Time. The County Administrator shall promulgate regulations to implement this section and Section 8. The regulations shall provide for a periodic choice by individual employees entitled to choose, subject to the requirements. of the employer, whether to be paid at the overtime rate or to receive compensatory time off at the rate established by board resolution. The regulations shall provide for accrual of such compensatory time off, which shall be in addition to permissible holiday time accumulation and total vacation accumulation permitted under Section 9. The regulations may provide for a certain fixed basis per year or per month regardless of the number of, actual or overtime holidays worked during the period by the various employees choosing this method of compensation. The Board may from time to time by resolution make other provisions for extra pay or other benefits to employees for work in addition to their normal work times. (Ord. ' 79-111; Prior Ord. The Employee Relations Officer is directed to give notice of this Resolution to each recognized employee organization, and provide such organization an opportunity to meet and confer as soon as practicable, to the extent that the provisions of this Resolution are subject to meeting and conferring under the Meyers-Milias-Brown Act. 5. Effective Date. This resolution is effective immediately for all management and unrepresented employees. It shall be effective for all represented employees to the extent not inconsistent with applicable memoranda of understanding, 10 days after notice is given as provided for in section 3, provided however, if any recognized employee organization requests to meet and confer within the 10 day period, this resolution shall not be applicable to employees represented by such organization until the conclusion of the meet and confer process.
