THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on June 4, 1991 by the following vote:
AYES: Supervisors Schroder, Torlakson and Powers
NOES: None
ABSENT: Supervisors Fanden and McPeak
ABSTAIN: None RESOLUTION NO. 91/34,5
SUBJECT: Approval of the Parcel Map and Road Improvement Agreement
for Improvement Warranty and Completion of Improvements
for Subdivision MS 90-86, E1 Sobrante Area.
The Public Works 'Director having notified this Board that the
improvements for Subdivision MS 90-86, being developed by Cook
Construction Company have been completed and that such improvements
have been constructed without the need for a Subdivision Agreement;
The following documents were presented for Board approval this
date:
The Parcel , Map of Subdivision MS 90-86, property located in
the E1 Sobrante area, said map having been certified by the proper
officials.
A Road Improvement Agreement for Improvement Warranty with
Cook Construction Company, subdivider, whereby said subdivider
agrees to warrant all improvements required in said Agreement
within one year from the completion date.
Said documents were accompanied by:
I. Security to warrant the completion of road and drainage
improvements as required by Title 9 of the County
Ordinance Code, in the form of a cash deposit (Auditor's
Deposit Permit No. 189801, dated May 3 , 1991) in . the
amount of $4,875 ($1,125 for faithful performance and .
$3,750 for labor and materials) made by Cook Construction
Company.
II. Letter from the County Tax Collector stating that there
are no unpaid County . taxes heretofore levied on the
property included in said map and that the 1990-91 tax
lien has been paid in full and the 1991-92 tax lien,
which became a lien on the first day of March, 1991, is
estimated to be $1, 000.
III. Security to guarantee the payment of taxes as required by
Title 9 of the County Ordinance Code, in the form of a
cash deposit (Auditor's Deposit Permit No. 189720 dated
May 2, 1991) made by Karen Cook in the amount of $1, 000
guaranteeing the payment of the estimated tax;
NOW THEREFORE BE IT RESOLVED that said subdivision, together
with the provisions for its design and improvement, is DETERMINED
to be consistent with the County's general and specific plans.

BE IT FURTHER RESOLVED that said Parcel Map is APPROVED and
this Board does not accept or reject on behalf of the public any of
the streets, paths, or easements shown thereon as dedicated to
public use.
BE IT FURTHER RESOLVED that said Road Improvement Agreement
for Improvement Warranty is also APPROVED.
BE IT FURTHER RESOLVED that the improvements in the above-
named development have been COMPLETED as of May 28, 1991 thereby
establishing the six-month terminal period for the filing of liens
in case of action under said agreement.
BE IT FURTHER RESOLVED that the $3,750 cash security for labor
and materials (Auditor's Deposit Permit No. 189801, dated May 3,
1991 deposited by Cook Construction Company be RETAINED for the
six-month lien warranty period until November 28, 1991, at which
time the Public Works Director is AUTHORIZED to refund the cash
security less the amount of any claims on file.
BE IT FURTHER RESOLVED that the $1, 125 cash deposit (Auditor's
Deposit Permit No. 189801, dated May 3, 1991) made by Cook
Construction Company be RETAINED for one year pursuant to the
requirements of Section 94-4 .406 of the Ordinance Code.
