Code § 8335) SUBJECT: Termination of Offer of Dedication of a portion of Miranda Creek . Drainage Easement, No. V2076, W. O. 8365, CP91-10, Alamo Area. The Board of Supervisors of Contra Costa County RESOLVES THAT: This Termination of an Offer of Dedication of a certain excess right of way not required for drainage purposes, is made pursuant to Government Code Section 66477.2(c) and to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, commencing with Section 8330. This termination request is for an Offer of Dedication of a portion of Miranda Creek drainage easement as shown on the map of Subdivision 6706, filed by Louis F. Plummer, Jr., and recorded on May 2, 1989, in Book 333 of Maps at Page 1, in the Office of the County Recorder of the County of Contra Costa. Said easement is located in the Alamo area. A description of the offered area to be terminated is attached hereto as Exhibit "A" and incorporated herein by reference. This termination of an offer of dedication is for a drainage easement which has not been used for the purpose for which it was dedicated for five consecutive years immediately preceding the date of this action. (S. & H. Code Section 8333). Considering all facts before it, this Board FINDS there is no reasonable probability that the County will accept the offered drainage easement into the County drainage system, that no public money has been expended for maintenance of the offered drainage easement, and that it is in the best interests of the County and the public that the offered area be privately owned and maintained. June 11, 1991 Page 2 This Board hereby FINDS that the proposed termination will not have a significant effect on the environment, and that it has been determined to be categorically exempt from the California Environmental Quality Act under State CEQA Guidelines Section 15312. The Public Works Director is ORDERED to file a Notice of Exemption with the County Clerk. The Planning Commission having filed its general plan report concerning this proposed termination and this Board having considered the general plan, FINDS pursuant to Government Code Section 65402 that this proposed vacation is in conformance with the general plan. This Board hereby TERMINATES the hereinabove described offer of dedication and ABANDONS the right of the County to accept said offer. The Board is not aware of any existing in place utilities in the subject area. The Real Property Division is ORDERED to record a certified copy of this Resolution in the office of the County Recorder. From and after the date this resolution is recorded, the offer of dedication is terminated and the County's right to accept offer is abandoned. Orig. Dept.: Public Works (R/P) cc: Public Works Maint. BEGINNING at the intersection of the northerly line of the drainage easement traversing said Lots 1 and 7 as shown on said map with the westerly line said of Lot 1, said Point of Beginning lies North 11°53'47" West, 60.00 feet from the most southern corner of said Lot 1; thence leaving said Point of Beginning along said westerly line of Lot 1, South 11°53'47" East, 13.70 feet; thence leaving said westerly line North 80°00'00" East, 93.64 feet; thence North 77°40'00" East, 167.00 feet; thence North 84°08'00" East, 41.00 feet; thence along a tangent curve to the right having a radius of 200.00 feet through a central angle of 17°12'00" for an arc length of 60.04 feet; thence South 78°40'00" East, 66.00 feet; thence South 70°30'26" East, 137.85 feet to a point on the easterly line of Lot 7 as shown on said map; thence along said easterly line North 12°14'28" East, 0.50 feet to the intersection with said northerly line of said drainage easement; thence leaving said easterly line of Lot 7 along said northerly line of said drainage easement the following courses and distances: North 69°31'56" West, 144.46 feet; North 78°04'47" West, 123.86 feet; South 79°31'21" West, 216.79 feet; South 77'50'13" West, 85.72 feet to the Point of Beginning.
