HomeMy WebLinkAboutRESOLUTIONS - 04161991 - 91-226 S.1 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA IN THE MATTER OF RESOLLMON NO. 91/226 Declaring the Board's Opposition to Senate Bill 144 WHEREAS, this Board has endorsed a toll road demonstration project in East Contra Costa County; WHEREAS,the Mid-State Tollway has been licensed by CaMans. The tollway will be constructed on State land,will be owned by the State, and the operation of the Tollway including collection of tolls will revert to the State once the private investment is repaid; WHEREAS,the Mid-State Tollway is intended to be an effective growth manage- ment tool to guide and serve planned development in the Facility Service area through Agreements between the Toll Road Developer and the Counties and Cities through which it passes; WHEREAS,the Mid-State Tollway is intended to be an effective environmental management tool for limiting access to environmentally sensitive lands within the Facility Service Area;for protecting valuable environmental resources;and for promot- ing the preservation of prime agriculture lands,all through agreements between the Toll Road Developer and the Counties and Cities through which it passes; the Mid-State Tollway is intended to be designed, constructed in phases, and operated in a manner to reduce congestion and encourage multiple occupancy vehicles,and contribute to the improvement of air quality standards. It will provide major relief for traffic congestion in the existing developed areas of Central and East Contra Costa County; WHEREAS,there are no adopted State Plans nor State funds in the foreseeable future to provide an additional transportation corridor in East Costra Costa County. There are inadequate local funding sources to construct a highway in East Contra Costa County and financial analyses have shown that the desired highway project cannot be constructed with tolls as a sole source of funding; a public-private partnership involving the State,local governments, and private industry represents the most efficient method of constructing the new highway; WIEREAS, local matching funds for State and Federal projects are common. Local fees and dedication of property for infrastructure facilities are universally used in this State by local government; WHEREAS, the provisions of the proposed SB 144, would prohibit local government from using any public funds, defined to include development fees and dedicated rights-of-way, to assist in the construction of a toll road demonstration project, thereby preventing the desired public-private partnership; RESOLUTION NO. 91/226 WHEREAS,this Board does not consider development fees or dedicated rights- of-way to constitute public tax dollars; NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Contra Costa County, does hereby RESTATE its support for the Mid-State 7bllway project and its Resolution to undertake such other actions as are reasonable to promote the development of the Mid-State Tollway; OPPOSE the use of public tax dollars such as gas tax,sales tax,and property tax to support private ventures;and ENDORSE the efficient use of local fees for necessary infrastructure projects,including a toll road project; BE IT FURTHER RESOLVED that the Board is OPPOSED to SB144 and respectfuly requests members of the Legislature to vote in opposition to SB144 in order to allow local government the opportunity to use local funds in the most cost-effective manner, unless SB144 is amended to exempt development fees and dedications of rights-of-way from the definition of public funds.
