HomeMy WebLinkAboutRESOLUTIONS - 03191991 - 91-178 CONTRA COSTA COUNTY BOARD OF SUPERVISORS Adopted this Resolution on March 19, 1991 , by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson and Powers NOES: None ABSENT: None RESOLUTION NO. 91/178 (Government Code § 25350) SUBJECT: Consummate Purchase and Accept Grant Deed Accept Assignments of Agreements 50 Douglas Drive Martinez Area W.O. 5164 The Board of Supervisors of Contra Costa County, RESOLVES THAT: This Board on February 12, 1991, passed Resolution of Intention No. 91/96 and Notice fixing March 19, 1991, at 11:00 A.M. in its Chambers, County Administration Building, 651 Pine Street, Martinez, California, as the time and place where it would meet to consummate the purchase of the real property described therein from Bank of the West, a California Banking Corporation, said property being required for office purposes. Said Resolution was duly published in the Contra Costa Times in compliance with Govt. Code Section 6063. The Board hereby; 1. CONSUMMATES said purchase and EXERCISES the County's Option to Purchase the office complex at 50 Douglas Drive, Martinez; California, in accordance with the terms of the Lease dated January 22, 1991, between Bank of the West and the County; 2. ACCEPTS assignment of the lease between Bank of the West and R. J. Roberts, Inc. dated August 20, 1987, as amended by four Addenda, two dated August 20, 1987, and the other two dated March 16, 1988 and March 28, 1989, and AUTHORIZES the Director of General Services to execute the "Assignment and Assumption of Leases' agreement between Bank of the West and the County; 3. ACCEPTS assignment of the agreement dated as of January 22, 1991, between Bank of the West as owner and Interactive Resources, Inc. as architect, for architectural services for tenant improvements on the first floor at 50 Douglas Drive, Martinez; 4. ACCEPTS the deed from Bank of the West, a California Banking Corporation, and ORDERS the Real Property Division to have it recorded together with a certified copy of this resolution. Funds for the purchase were provided from the sale of Certificates of Participation to finance the 1991 County Buildings Acquisition Project as approved by the Board of Supervisors on January 22, 1991, by Resolution No. 91/63. The funds were deposited with the Trustee, Bank of America, who will transfer the amount for the purchase to the escrow agent for disbursement in accordance with the County's final escrow instructions for the acquisition. orig.: Public Works (R/P) cc: Auditor-Controller (via R/P) Public Works Accounting County Recorder (via R/P) PBG:rs C:brl6b.t3 RESOLUTION NO. 91/ 178 SUBJECT: Consummate Purchase and Accept Grant Deed 50 Douglas Drive, Martinez Area March 19, 1991 Page 2 This Board has reviewed the City of Martinez's Environmental Impact Report dated August, 1982, which included this property, and has DETERMINED the County is acting as a Responsible Agency pursuant to Section 15381 of the California Environmental Quality Act. The Board FINDS that changes or alterations are within the responsibility and jurisdiction of the City of Martinez and not the County, and that such changes have been adopted by the City of Martinez. The Board hereby ADOPTS those mitigating measures which pertain to the County's project; DIRECTS the General Services Department to provide preferred parking for carpools in accordance with the County's Transportation Systems Management guidelines; and DIRECTS the Community Development Department to file a Notice of Determination with the County Clerk pursuant to Section 15096. The City of Martinez has determined that the project conforms to the City's General Plan.
