The Board of Supervisors of Contra Costa County, RESOLVES THAT:
This Board on February 12, 1991, passed Resolution of Intention No. 91/95.and
Notice fixing March 19, 1991, at 11:00 A.M. in its Chambers, County Administration
Building, 651 Pine Street, Martinez, California, as the time and place where it would meet
to consummate the purchase of the real property described therein from Vista Oaks, a
California Limited Partnership, said property being required for office purposes. Said
Resolution was duly published in the Contra Costa Times in compliance with Govern-
ment Code Section 6063.
The Board hereby CONSUMMATES said purchase and EXERCISES the County's
Option to Purchase the office complex at 40 Douglas Drive, Martinez, California, in
accordance with the terms of the Second Modification to Lease dated February 27, 1990,
as amended by the Third Modification to Lease, dated July 17, 1990 between Vista Oaks
and the County.
The Deed from Vista Oaks, a California Limited Partnership, is hereby ACCEPTED
and the Real Property Division is ORDERED to have it recorded, together with a certified
copy of this resolution.
Funds for the purchase were provided from the sale of Certificates of Participation
to finance the 1991 County Buildings Acquisition Project as approved by the Board of
Supervisors on January 22, 1991, by Resolution No. 91/63. The funds were deposited
with the Trustee, Bank of America, who will transfer the amount for the purchase to the
escrow agent for disbursement in accordance with the County's final escrow instructions
for the acquisition.
This Board has reviewed the City of Martinez's Environmental Impact Report dated
August, 1982, which included this property, and has DETERMINED the County is acting
as a Responsible Agency pursuant to Section 15381 of the California Environmental
Quality Act. The Board FINDS that changes or alterations are within the responsibility
and jurisdiction of the City of Martinez and not the County, and that such changes have
been adopted by the City of Martinez. The Board hereby ADOPTS those mitigating
measures which pertain to the County's project; DIRECTS the General Services
Department to provide preferred parking for carpools in accordance with the County's
Transportation Systems Management guidelines; and DIRECTS the Community
Development Department to file a Notice of Determination with the County Clerk pursuant
to Section 15096. The City of Martinez has determined that the project conforms to the
City's General Plan.
