ABSTAIN: SUBJECT: Master Property Tax Transfer Agreement ) with Contra Costa Water District for ) the Los Vaqueros/Kellogg Project Watershed ) RESOLUTION 89/ 450 Area Annexations (LAFC Map No. 4/88:6) ) WHEREAS, Section 99 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not been previously provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, with the exception of the annexing district, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer; and WHEREAS, the Contra Costa Water District (CCWD) will at various times initiate annexations of territory within the Sphere of Influence of the Los Vaqueros/Kellogg Project Watershed Area as shown as Local Agency Formation Commission Map No. 4/88:6; and WHEREAS, CCWD is the only affected agency in pending and future annexations involving the Los Vaqueros/Kellogg Project Watershed Area (LAFC Map No. 4/88:6) and the District has agreed that no property tax be exchanged as a result of these annexations. NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY HEREBY DETERMINES that no property tax will be transferred to CCWD as a result of annexing the territory described in the subject annexations. This resolution does not change the property tax revenues accruing to other agencies serving the subject territory or the affected district's right to collect, taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission.
