HomeMy WebLinkAboutRESOLUTIONS - 06061989 - 89-358 I.36 THE BOARD 'OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on June 6, 1989 by the following vote: AYES: Supervisors Powers , Fanden, Schroder, McPeak & Torlakson NOES: None ABSENT: None RESOLUTION NO.89/358 (Health & Safety Code ABSTAIN None SS4762, 5463, 5474) SUBJECT: Notice of hearing to require buildings to be connected to Sanitation District 15 's system; to declare failure to connect a nuisance; to order connection; to authorize connection by District. The Board of Supervisors of Contra Costa County, as governing body of the County of Contra Costa, and as the Board of Directors of Contra Costa County Sanitation District No. 15, resolves that: The Citizens Advisory Committee of Contra Costa County Sanitation District No. 15 reports that a number of parcels within the District's boundary eligible for connection to the District's sewage system are not connected to the system and are utilizing other means of disposal which pre-date the establishment of the District's system. The Committee recommends that this Board exercise its authority to compel these parcels to be connected to the District's system, to share in the costs of operating the District' s system and to comply with Order No. 74-125 of the California Regional Water Quality Board for the Central Valley Region. On June 27, 1989 at 11: 00 a.m. in the Board of Supervisors' Chambers at 651 Pine Street, Martinez, California, this board will hold a hearing to determine: whether to prohibit the use of septic tanks,: cesspools or other local means of sewage disposal on the parcels of properties within the District described in attached Exhibit "A" ; whether to declare the use of such local means of sewage disposal to be a nuisance; whether to order such properties and buildings thereon to be connected to the District's system; whether to authorize the District to connect the offending properties and buildings if connection to the District's system is not made by the owner; and thereafter impose the costs of such connections as liens against the involved properties to be collected on the tax roll. Any person and the owners of parcels who may be affected by this Board' s action have a right to appear at such hearing and be heard on all matters to be considered'; and or determined, including the proposed imposition of such connection charges against the land. If the Board authorizes the District to connect a dwelling house (building, etc. ) to the District' s system, the costs of such connection shall be chargeable to the owner and may become a lien against the land upon which the building is located and all laws applicable to the levy, collection and enforcement of taxes of the County shall apply to such costs. The Engineering Services Division of the Public Works Department is DIRECTED to send notice in substantially the following form to all owners of property who may be affected by this Board' s actions, whose names and parcels of property are described in Exhibit "A" attached hereto and incorporated herein by this reference: RESOLUTION NO. 89/358 0 NOTICE OF PUBLIC HEARING AND TIME FOR OBJECTIONS The Board of Supervisors of Contra Costa County, as the governing body of the County of Contra Costa and as the Board of Directors of Contra Costa County Sanitation District No. 15 will meet and hold a public hearing (at which any person may appear and object) on June 27 , 1989 , 1989 at 11 : 00 a.m. in the Board of Supervisors ' Chambers at 651 Pine Street, Martinez, California to consider and determine: 1. Whether to prohibit the use of septic tanks, cesspools or other local means of sewage disposal for buildings used or inhabited by human beings, located on the parcels described in attached Exhibit "A" which are within the District's boundaries, within the unincorporated area of Contra Costa County and situated within that distance from a main sewer of the District that is obtained by multiplying 250 feet by the number of service units on the parcel, as such service units are defined by District Ordinance No. 1, as amended. 2 . Whether to declare such use to be a public nuisance; 3 . As to such parcels, whether to order the owners within 90 days of written notice, to connect the buildings thereon, together with all toilets, sinks, and other plumbing, properly vented and in a sanitary manner, to the nearest District sanitary sewer; 4 . Whether to authorize the District to construct and make the connection if the owner has not done so within 90 days of an order to connect and ultimately impose the costs thereof as liens upon the involved properties to be collected on the tax roll; and 5. As to each of the parcels listed in Exhibit "A" , whether it: 1) is located within the District's boundaries, within the unincorporated area of Contra Costa County, and 2) is within that distance from a main sewer of the District that is obtained by multiplying 250 feet by the number of service units on the parcel, as such service units are defined by District Ordinance No. 1, as amended; and 3) has located on it a building used or inhabited by human beings not connected to a main sewer of the District. 1 hereby certify that this Is a we and correct copy of an action taken and entered on the minutes of the Board of Supenrlson on the date shown. A sewer lateral was extended from the sewer main to the front property line. This property can connect to the sewer without exceeding the 250 foot per service unit limit. Note No. 1 The dwelling units at 60 Sunset Drive (APN 031-080-027-1) and 70 Sunset Drive (APN 031-080-026-3) are approximately 40 feet apart. If they cooperated they could put their sewer lines in the same trench and reduce their costs. They could also install a single line to their common property line and then connect at that point. If they wanted to install a line to the Taylor Road sewer the distance would be about 350 feet which is under their combined limit of 500 feet.
