SUBJECT: Implementation of RESOLUTION NO. 89/ 428
Penal Code 1463 . 28
The Contra Costa County Board of Supervisors RESOLVES t' the
Recommended Action herein is taken:
I . Recommended Action.
Adopts a resolution implementing Section 1463 . 28 c ie Penal
Code directing that future increments in fines ar jrfeitures
be deposited in the County general fund, up to t , annual
allowable limit of $100, 000, as provided for it a statute .
II . Financial Impact.
The County General Fund will receive up to or maximum of
$100, 000 per year until December 31 , 1992 when section 1463 . 28
of the Penal Code is repealed.
III . Background.
Some option Counties participating in the Trial Court Funding
program may adopt a resolution authorizing a county upon the
increase of bail schedules for all misdemeanor and infraction
offenses to deposit in the County general fund the amount
attributable to the increase in bail up to an annual limit . The
annual limit established for Contra Costa County is $100,000 .
IV. Consequences of Negative Action.
Without passage of this resolution the County would lose the
ability to retain the first $100 , 000 attributable to fine and
forfeiture increases, such increase would be divided between the
County and the cities withing the County.
V. General Discussion.
The Courts with the agreement of the cities within the County
have developed a cost effective mechanism to account for the
$100,000 attributable to fine and forfeiture increases . The
Courts and the cities have elected to only account for the
increase in prior bail enhancement. To identify bail increase
on a transaction by transaction basis would require the
development of extremely costly programming and procedural
changes . It is believed that the new prior enhancement bail
agreement with the cities maximizes returns to both the County
and the cities without incurring substantial costs .
