HomeMy WebLinkAboutRESOLUTIONS - 04181989 - 89-257 T_ 1 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on —April 18, 1989 , by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak and Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: In the Matter of the Creation ) RESOLUTION NO. 89 257 of the Kensington Municipal ) Advisory Council ) It is hereby RESOLVED by the Board that: 1 . Creation of the Kensington Municipal Advisory Council. Pursuant to the authority granted by Section 31010 of the California .Government Code, the Kensington Municipal Advisory Council (KMAC) is hereby created. 2 . Membership. The Council shall consist of five (5) members who shall be residents of the Kensington community (as described below) , shall have resided there for at least five years prior to assuming office., and who shall be appointed by the County Board of Supervisors from lists of nominees submitted by the Kensington Improvement Club, the Kensington Property Owners' Association, the Kensington Community Services District, and the Kensington Fire District. Each organization shall only nominate residents having the above listed qualifications and who have been approved by a majority of the board of directors of the involved organization. 3 . Kensington Community. The Kensington Community is that area contained within the boundaries of the Kensington Community Services District and the Kensington Fire District. 4 . Term of Office. The Council members shall serve four (4) year terms except that for the initial Council, the Board shall, by lot, select two members who shall serve two (2) year terms and three members who shall serve four (4) year terms. 5. Council Duties and Powers . The Council shall advise the Board of Supervisors on land use and planning matters affecting the Kensington community, primarily zoning variance applications, and may represent the Kensington community before the County Planning Commission, the Zoning Administrator, and the County Board of Supervisors on such land use, planning and zoning matters . The Council may also request related County assistance concerning the foregoing planning matters which, if legally appropriate and funded, may be provided. It is understood that the Board of Supervisors is the final decision- making authority with respect to .issues concerning the Kensington community and that the Council shall serve solely in an advisory capacity. Except as specified above, the Council shall not represent the Kensington community on any other matter. 89/257 f 6 . Compensation. Council members shall serve without compensation of any kind and the Board shall not provide funds for the payment of Council meeting stipends or reimbursement of Council members' expenses . 7 . Staff and Financial Support. a. The Board shall provide no ongoing professional or clerical staff support to the Council or provide funds to pay for any of the Council's operating costs . b. County staff will provide the Council in a timely manner with information and reports on planning matters (proposed General Plan and zoning changes, land use permits, variance and subdivisions applications, etc. ) which take place in, or will have an effect on the Kensington community. C. County staff will provide Kensington Community planning entitlement applicants with the time and place of council (KMAC) meetings and the names and any non-restricted phone numbers of Council members so that timely discussion of pending applications may be conducted between them (the Council and applicants) before County Planning Agency hearings and decisions . 8 . Council Operation. Within the parameters of this Resolution, the Council may organize itself an operate as it determines but shall hold regular meetings at least monthly at an established time and place. Any such meeting may be adjourned to the next regular monthly meeting date if there is no business to be transacted at that time. The Council's open public meetings shall be conducted in accordance with the provisions of the "Brown Act" (Government Code Secs . 54950 ff. ) including the pre-meeting posting of meeting calendar notices. 9 . Council Establishment Not Subiect to Vote. The issue of initial establishment of the Council shall not be an election item submitted to the voters of the Kensington community. 10. Council Dissolution - 1993 . The provisions of this Resolution shall be of no further force and effect after July 1, 1993 and the Council dissolved on that date unless prior to it (7-1-93) , the Board of Supervisors has taken action to extend the Council's existence following an advisory vote of the Kensington Community electorate. 1 hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Sup4BAHELOR. on the date shown.
