ABSTAIN: None RESOLUTION NO. 89/141
SUBJECT: Amending Subdivision Agreement Subdivision 6645, San
Ramon Area.
The Public Works Director having notified this Board that
the improvements in Subdivision 6645 are over 80% completed as
provided in the Subdivision Agreement with Shapell Industries of
Northern California heretofore approved by this Board in
conjunction with the filing of the Subdivision Map.
The Public Works Director having further notified this
Board that said subdivision has been annexed by the City of San
Ramon, and that the County has continued to perform inspection
services and perform routine staff duties in processing the
subdivision until its completion as agreed to with the City, and
that the City recommends amending the Subdivision Agreement to
allow the performance bond to be reduced to no less than 20% of
the original bond amount;
The Public Works Director having also presented to this
Board a surety bond rider dated February 6, 1989 and issued by
American Casualty Company of Reading Pennsylvania to change the
performance bond amount of bond number 9266387 dated December 6,
1985 from $40, 100 to $8, 020.
NOW THEREFORE BE IT RESOLVED that the Subdivision Agreement
for subdivision 6645, approved by this Board on December 17,
1985, is hereby AMENDED to allow reduction of the performance
bond.
BE IT FURTHER RESOLVED that the $1, 000 cash deposit
(Auditor's Deposit Permit No. 101681, dated December 10, 1985)
made by Shapell Industries of Northern California be RETAINED
pursuant to the requirements of Section 94-4 .406 of the Ordinance
Code.
