THE BOARD OF SUPERVISORS

Adopted this Resolution on February 7, 1989, by the following
vote:

SUBJECT: Conveyance of Easement to EBMUD.
Wildcat Creek Utility/Access Route
Project No. 7527-6B8617
Richmond Area
The Board of Supervisors as the Governing Body of Contra
Costa County Flood Control and Water Conservation District
RESOLVES THAT:
The District acquired the real property along Wildcat
Creek in Richmond, for utility relocation and access purposes.
The EBMUD has requested an easement over a portion of said
property, described in Exhibit "A" attached hereto, for a water
line relocation. This Board FINDS that the conveyance of such
easement is in the public interest and will not substantially
conflict or interfere with the District's use of the property.
This Board hereby APPROVES and AUTHORIZES the conveyance
of an easement to EBMUD, over the property described in Exhibit
"A" attached hereto, pursuant to Government Code Section 25526.6
and the Board Chair is hereby AUTHORIZED to execute an easement
on behalf of the District in exchange for the Quitclaim of the
portion of the relocated water line easement area lying within
District's lands.
The Real Property Division is DIRECTED to cause said
easement to be delivered to the grantee.
The Board hereby FINDS that the project will not have a
significant effect on the environment, and DETERMINES that the
project is exempt from the requirements of the California
Environmental Quality Act as a Class 12 Categorical Exemption
under County Guidelines and Section 15312 of the State CEQA
Guidelines, and DIRECTS the Public Works Director to file a
Notice of Exemption with the County Clerk. This activity has
been found to conform to the General Plan of the County.

EXHIBIT "A"
A portion of that parcel of land described in to the West Contra Costa
Sanitary District, formerly the San Pablo Sanitary District, recorded July 17,
1953 in Book 2162 at page 82 of Official Records and a portion of that parcel
of land described in the Final Order of Condemnation by the Contra Costa
County Flood Control and Water Conservation District recorded March 10, 1987
in Book 13498 at page 131 of Official Records, records of Contra Costa County,
State of California described as follows:
PARCEL ONE:
Commencing at the 1-1/2-inch iron pipe monument at the centerline intersection
of Parr Boulevard and Garden Tract Road as shown on the map entitled "A"
Precise Section of the Streets and Highways Plan, Contra Costa County, North
Richmond Bypass" recorded November 5, 1969 in Book 5998 at page 209 of
Official Records of said County, said 1=1/2-inch iron pipe monument bears
north 88007'51" west 701.80 feet from a standard Contra Costa County street
monument at the intersection of North Richmond Bypass and Parr Boulevard as
shown on said map; thence from said point of commencement south 17045'41" west
213.27 feet to Point "1E" as said point is described in Parcel 1260.1 in the
Complaint in Condemnation, Case Number C88-02367, filed June 14, 1988 in
Superior Court of California, Contra Costa County Flood Control and Water
Conservation District versus C. Overaa and Company, et. al; thence from said
Point "1E" along the southwesterly line of said Parcel 1260.1 north 57000'00"
west 139.33 feet to the Point of Beginning of the following described parcel
of land.
Thence from said Point of Beginning leaving said southwesterly line north
33000'00" east 273.22 feet to the easterly line of said Contra Costa County
Flood Control and Water Conservation District parcel (13498 O.R. 131) ; thence
along said easterly line south 1003',10" west 47.25 feet; thence leaving said
line south 33000'00" west 233.13 feet to the said southwesterly line of parcel
1260.1 (case number C88-02367) ; thence along said line north 57000'00" west
25.00 feet to the Point of Beginning.
PARCEL TWO-
Beginning at said Point '11V described above in Parcel One; thence from said
Point of Beginning along the easterly line of said West Contra Costa Sanitary
District (2162 O.R. 82) north 1003'10" east 5.89 feet to a point on a line
which is parallel with and 5.00 feet northerly, right angle measure, of the
northerly line of Parcel One described above; thence along said parallel line,
north 57000'00" west 111.21 feet; thence leaving said line south 33000'00"
west 5.00 feet to a point on the northerly line of Parcel One described above;
thence along said northerly line, south 57000'00" east 114.33 feet to said
Point "lE", the Point of Beginning.
