RESOLUTION NO.88/241
SUBJECT: Exoneration of Subdivision Agreement and Release of
Cash Deposit, Subdivision MS 33-84, Walnut Creek Area.
The Board having approved a Subdivision Agreement with Floyd
R. Norried, Jr. and Marilyn Norried, effective October 23, 1984,
for construction of certain improvements in Subdivision MS 33-84,
Walnut Creek area.
The Public Works Director having reported that the parcels
of the two lot subdivision have been combined into a single
parcel, as shown on the record of survey for lot line adjustment
LL 84-86, filed January 22, 1987, in Book 82 of Licensed
Surveyors' Maps at page 4, Official Records of Contra Costa
County.
The Public Works Director having further reported that this
combining of the two parcels into one has eliminated the need for
subdivision improvements or a subdivision agreement.
NOW THEREFORE BE IT RESOLVED that the Subdivision Agreement
approved by the Board on October 23, 1984, is hereby EXONERATED.
BE IT FURTHER RESOLVED that the Public Works Director is
AUTHORIZED to refund the cash deposit (Auditor's Deposit Permit
No. 84747, dated October 17, 1984, in the amount of $1, 000) , plus
interest in accordance with Government Code Section 53079, if
appropriate, to Floyd R. Norried, Jr. and Marilyn Norried.
