WHEREAS, Section 99. 1 of the Revenue and Taxation Code provides that a
jurisdictional change resulting from a special district providing one or
more services to an area where such services have not previously been
provided shall not become effective if one or more affected special
districts involved in the property tax exchange negotiation fails to adopt
a resolution agreeing to a transfer; and
WHEREAS, the Board of Supervisors shall determine the property tax exchange
for each affected district that fails to adopt a resolution agreeing to a
property tax transfer, except for the annexing district; and
WHEREAS, the West Branch Annexation to East Bay Municipal Utility District
(LAFC 87-64) involves annexation of territory to the East Bay Municipal
Utility District (EBMUD) for which property tax exghange is determined by
the previously approved master property tax exchange agreement; and
WHEREAS, the annexation may be amended to include annexation of territory
to the San Ramon Valley Fire Protection District (SRVFPD) and - the
concurrent detachment of such territory from the Tassajara Fire Protection
District (TFPD) and;
WHEREAS, for the property tax allocation to be made under this resolution,
the Auditor-Controller of Contra Costa County shall apply the provisions of
the master property tax agreement between EBMUD and the County;
WHEREAS, in the case of the fire district annexation/detachment element of
the proposed annexation, 1000 of the property tax accruing to TFPD from the
affected territory of the potential annexation shall be transferred to
SRVFPD;
THEREFORE, BE IT BY THE BOARD OF SUPERVISORS -OF CONTRA COSTA COUNTY
RESOLVED that the property tax increment allocation factors for the
affected agencies in the area of the West Branch Annexation to East Bay
Municipal Utility District (LAFC 87-64) shall be in accordance with the
master property tax agreement between EBMUD and the County and if the
annexation is amended so as to impact fire districts, 1000 of the property
tax accruing to TFPD from the affected territory of the subject annexation
shall be transferred to SRVFPD. The terms of this property tax exchange
agreement shall be effective for the fiscal year for which the State Board
of Equalization makes the tax rate area changes for this jurisdictional
change and shall apply in subsequent years unless changed by the mutual
agreement of affected agencies or subsequent jurisdictional changes. This
resolution does not change the property tax revenues accruing to other
agencies servicing the subject territory or the affected agencies right to
collect taxes for existing bonded indebtedness. The property tax exchange
agreement discussed above, shall apply to affected territory as submitted or
revised by the Local Agency Formation Commission.
