HomeMy WebLinkAboutRESOLUTIONS - 06231987 - 87-381 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on June 23 , 1987 by the following vote : AYES: Supervisors Fanden, Schroder, Torlakson and McPeak NOES: None ABSENT:_ Supervisor Powers ABSTAIN: None RESOLUTION NO. 87/381 SUBJECT: Approval of the Final Map, Road Improvement Warranty Agreement and Subdivision Agreement for Subdivision 6763 , Pleasant Hill BART Area. The following documents were presented for Board approval this date: The Final, . Map of Subdivision 6763 , property located in the Pleasant Hill BART area , said map having been certified by the proper officials ; A Subdivision Agreement with Treat Commons Associates, subdivider, whereby said subdivider agrees to complete all on site improvements as required in said Subdivision . Agreement within one year from the. date of said agreement; A Road Improvement Warranty Agreement with Treat Commons Associates , developer, whereby said developer agrees to guarantee and maintain the completed improvements for one year from the date of said agreement; Said documents were accompanied by: I . Security to guarantee the completion of road and drainage improvements as required by the Subdivision Agreement and Title 9 of the County Ordinance Code, as follows : A . Cash deposit (Auditor ' s Deposit Permit No . 118238, dated December 30, 1986 ) in the amount of $1 , 325 made by Treat Commons Associates. B . Additional security in the form of a cash deposit (Auditor ' s Deposit Permit No. 124781 , dated May 22 , 1987 ) in the amount of $123 ,925 ($82 , 175 for faithful performance and $41 , 750 for labor and material's ) made by Treat Commons Associates . II . Security to guarantee the completion of road and drainage improvements as required by the Road Improvement Warranty Agreement and Title 9 of the County Ordinance Code , as follows : A. Cash deposit (Auditor' s Deposit Permit No . 124781 , dated May 22; 1987 ) in the amount of $1,000 made by Treat Commons Associates . B . Additional security in the form of a cash deposit ((Auditor 's Deposit Permit No. 124781 , dated May 22, 1987 ) in the amount of $30,850 ($6 , 350 for faithful performance and $24 , 500 for labor and materials ) made by Treat Commons Associates . i III . Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1986-87 tax lien has been paid in full and the 1987-88 tax lien, which became a lien on the first day of March , 1987 , is estimated to be $110 , 650; VI . Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code in the form of a cash deposit ( Auditor ' s Deposit Permit No . 124741 , dated May 22 , 1987 ) made by Trammell Crow Company in the amount of $110, 650 quaranteeing the payment of the estimated tax; NOW THEREFORE BE IT RESOLVED that said subdivision , together with the provisions for its design and improvement , is DETERMINED to be consistent with the County' s general and specific plans ; BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets , paths , or easements shown thereon as dedicated to public use . BE IT FURTHER RESOLVED that said Subdivision Agreement is also APPROVED. BE IT FURTHER RESOLVED that said Road .
