SUBJECT: Providing Assurances to the United States
in Connection with Construction of the
San Ramon Creek, Walnut Creek Bypass
Channel Improvements
Project No. 7520-688636
WHEREAS the U. S. Army Corps of Engineers, San Francisco District, has
advertised a contract for Construction of the San Ramon Creek, Walnut Creek
Bypass Channel Improvements , Phase II , - which improvements will extend from 200
feet north Mt. Diablo Blvd. to 1,800 feet north of Rudgear Road in the City of
Walnut Creek; and
WHEREAS the U. S. Army Corps of Engineers has requested the Contra Costa
County Flood Control and Water Conservation District to provide the United States
with such assurances as are necessary to initiate project construction;
NOW, THEREFORE, BE IT RESOLVED by this Board, acting as the governing
body of the Contra Costa County Flood Control and Water Conservation District,
that the Contra Costa County Flood Control and Water Conservation District
hereby provides the United States the following assurances:
(1) The project right of way will be available for construction of the
San Ramon Creek, Walnut Creek Bypass Improvements Phase II , - either as a temporary
construction easement , a right of entry, a permanent drainage easement, by
eminent domain or in fee after July 18, 1986 with the exception of parcels 19 and
22 which will be available after August 18, 1986.
(2) The utilities which lie within the design channel cross section
have been relocated outside the channel cross section except for those utilities
which will be relocated as part of the U. S. Army Corps of Engineers construction
project.
