8 The Board of Supervisors of Contra Costa County, California,
9 by vote of two-thirds or more of its members, RESOLVES that:
10 Pursuant to Government Code Section 25350 . 5 and Streets
11 & Highways Code Section 943 , Contra Costa County intends to
12 construct a temporary detour road, and replace existing
13 bridge with a concrete slab bridge, a public improvement, and,
14 in connection therewith, acquire interests in certain real
15 property.
16 The property to be acquired consists of . 083 acres in
17 fee and 2 . 506 acres for a temporary detour road and construction
18 area and is generally located in the Byron area. The said
19 property is more particularly described in Appendix "A" ,
20 attached hereto and incorporated herein by this reference.
21 On June 3, 1986 , this Board passed a resolution of
22 intention to adopt a resolution of necessity for the
23 acquisition by eminent domain of the property described in
24 Appendix "A" (Resolution No. 86/297) and set June 24 , 1986 ,
25 in its Chambers in the Administration Building, 651 Pine
26 Street, Martinez, California, as the time and place for the
27 hearing thereon.
28 The hearing was held at that time and place, and all

1 interested parties were given an opportunity to be heard and
2 based upon the evidence presented to it, this Board finds,
3 determines and hereby declares the following:
4 1. The public interest and necessity require the
5 proposed project; and
6 2. The proposed project is planned and located. in the
7 manner which will be most compatible with the greatest public
8 good and the least private injury; and
9 3 . The . property described herein is necessary for the
10 proposed project; and
11 4 . The offer required by Section 7267. 2 of the
12 Government Code was made to the owner or owners of record.
13 The County Counsel of this County is hereby AUTHORIZED
14 and EMPOWERED:
15 To Acquire in the County' s name, by condemnation, the
16 titles, easements and rights of way hereinafter described in
17 and to said real property or interest(s) therein, in
18 accordance with the provisions for eminent domain the Code
19 of Civil Procedure and the Constitution of California:
20 To prepare and prosecute in the County' s name such
21 proceedings in the proper court as are necessary for such
22 acquisition:
23 1. Parcel 3 : Fee Title
24 2. Parcel 4 : Temporary Construction Area - to expire
25 upon completion of construction or on December 31, 1987
26 whichever comes first.
27 To deposit the probable amount of compensation, based
28 on an appraisal, and to apply to said court for an order

1 permitting the County to take immediate possession and use
2 said real property for said public uses and purposes.
3 PASSED and ADOPTED on June 24, 1986, by the following vote:
4 AYES : Supervisors Fanden, Schroder, Torlakson and McPeak
5 NOES: None
6 ABSENT: Supervisor Powers
7 I HEREBY CERTIFY that the foregoing resolution was
8 duly and regularly introduced, passed and adopted by the
9 vote of two-thirds or more of the Board of Supervisors of
10 Contra Costa County, California, at a meeting of said Board
11 on the date indicated.
