In the Matter of Supporting S8 2613 ' RESOLUTION NO. 86/201
Relating to Foster Home Liability Insurance ) '
WHEREAS, Licensed foster family homes play an integral role in
California's child protection efforts by providing critically needed, cost-
effective out of home care and protection to abused and neglected children in
need of such services; and
WHEREAS, The growing unavailability of third-party liability
insurance in California has adversely affected licensed foster familyhomes
resulting in many licensed foster parents being without liability coverage and
placing their own income and resources at substantial risk when h$y accept
responsibility for abused and neglected children in their care^, and
WHEREAS, The unavailability of liability insurance coverage has
forced many licensed foster parents in California to seriously reevaluate
their continued role as caregivers in the protection of abused and neglected
children in the state', and
WHEREAS, Without an adequate supply of licensed family homes abused
and neglected children in need of out-of-home protection may end up being
placed for longer stays in emergency shelter care; or, inappropriately placed
in group homes, even though the child may not need that level Of care and
supervision; or, not removed from their homes because placement resources are
not available; and
WHEREAS, An inability to remove children in need of protection from
abusive homes because of diminished out-of-home placement resources is not in
the beat interests of children in this state; and whereas, extended stays in
emergency shelter or inappropriate placement in group homes are not in the
best interests of abused and neglected children and coat significantly more
than placement in licensed foster family homes;
IT IS BY THE BOARD RESOLVED that
l' Contra Costa County supports SB 2613 sponsored by Senators
Royce, Presley and Seymour which would temporarily require the State to assume
liability coverage for licensed foster family and small family homes until the
claims history of commercial foster home liability insurance can be evaluated
and methods of encouraging commercial coverage can be developed.
2. Director, Social Service Department, is authorized to send
copies of this Resolution to the author, to all other members of the
California State Legislature who represent Contra Costa County and to
Congressman George Miller.
