THE BOARO OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on April 9, 1985 by the following vote:

The Board on February 5, 1985, continued its hearing on the proposed Area of
Benefit, Bates Avenue/North Concord, to this date and time.
J. Michael Walford, Public Works Director, explained the hearing had been
continued so that discussions with the land owners on the subject of an assessment
district could continue. Mr. Walford advised that the feasibility of an assessment
district is tenuous at this point in time due to the relationship of the City of
Concord' s off-site improvement fees and the proposed County assessment district.
Mr. Walford advised that the Area of Benefit boundaries had been amended to
exclude properties within the City of Concord.
The Board of Supervisors of Contra Costa County FINDS that:
Government Code Section 66484 and Division 913, Title 9, of the Contra Costa
County Code provide for assessing and collecting fees for bridge and/or major
thoroughfare construction within a designated area of benefit as a condition of
approval of a final subdivision map or as a condition of issuing a building
permit; and
The Public Works Director and the Director of. Planning have completed a
development program report for the Area of Benefit which was filed with the Clerk
of the Board on November 15, 1984, and notice of the proposed hearing was duly
given in accordance with Section 913-6.014 of the Contra Costa County Code; .and
The following persons have filed letters of protests:
William Mortensen, 4010 Folsom Court, Concord, on behalf of a group of
businessmen.
Maurice E. Huguet, Jr. on behalf of the Concord Industrial Park.
Robert Rossi of Seeno Construction Company.
Don H. Gorman, 1667 St Lawrence Way, Pleasant Hill .
Supervisor Powers recommended and the Board of Supervisors APPROVED that:
1 . The two Seeno parcels, assessor parcel numbers 159-100-003 and
159-100-006 be deleted from the boundaries of the Area of Benefit.
2. Land Development entitlements, which involve the undeveloped parcel
above (APN 159-100-006) , require a condition for approval that requires
the participation in financing the signalization of the intersection of
the Highway 4 ramps and Arnold Industrial Way at the time the parcel is
developed.

A Negative Declaration pertaining to this project was published. The Board
reviewed and considered protests received during the review period and hereby
CONCURS in the findings that the project will not have a significant effect on
the environment and hereby DIRECTS the Public Works Director to file a Notice of
Determination with the County Clerk; and
This Board hereby DETERMINES that a majority protest does not exist, inasmuch
as a written protest has not been filed by the owners of more than one-half of
the area of the property to be- benefited by the improvement; and
This Board hereby ADOPTS the revised development program report with amend-
ments pertaining to its boundaries for the Bates Avenue/North Concord Area of
Benefit, and sets the fees at $20,000 per gross acre.
NOW, THEREFORE, IT IS HEREBY RESOLVED that an Area of Benefit is hereby
ESTABLISHED in the unincorporated North Concord area of the County of Contra
Costa pursuant to Section 913-6.024 of the Contra Costa County Ordinance Code,
the boundaries of which are described in the development program report pertaining
to the Bates Avenue/North Concord Area of Benefit and the Clerk of this Board is
DIRECTED to file a certified copy of this Resolution with the County Recorder as
specified in Section 913-6.026 of the Contra Costa County Ordinance Code.
