HomeMy WebLinkAboutRESOLUTIONS - 04301985 - T.9 C T.9 THE BOARD OF SUPERVISORS OF CONTRA .COSTA COUNTY, CALIFORNIA Adopted this Order on April 30, 1985 , by the following vote: AYES: Supervisors Powers , Schroder , McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None SUBJECT: Appeal of Gisele Hart from approval of Variance Application 1103-84 issued to Robert W. Lyon, Kensington area . This being the time for hearing on the appeal of Mrs . Gisele Hart from approval of variance application 1103-84 issued to Robert W. Lyon for a three-story residence , including a deck, and for setback variance for a residential addition, at 225 Stanford Avenue , Kensington area; Harvey Bragdon, Assistant Director of Planning , described the property and how the variance would affect the property and advised that the application was issued a categorical exemption from California Environmental Quality Act requirements . The chair declared the hearing open and the following per- sons appeared: 1 . Arthur M. Shelton , Attorney for appellant Gisele Hart , : who urged the Board to grant the appeal , suggesting that denying the appeal would adversely affect the appellant' s property rights and the value of her property and be precedent setting in a view -oriented community. 2. Tom Lavin, 7156 Norfolk Road , Berkeley, architect for the owner , who explained the plans for the addition proposed to be constructed under the variance . 3. Robert Lyon , 225 Stanford Avenue , Kensington , owner , who advised that the Kensington Improvement Association has recom- mended approval of the variance and who urged that the Board deny the appeal and uphold the granting of the variance application. 4. Mr . Shelton appeared in rebuttal and again urged the Board to grant the appeal of Mrs . Hart , suggesting that there are many simple ways the proposed design could be modified so as to not interfere with Mrs . Hart' s view . , The public hearing was thereupon closed and Supervisor Powers requested a week to view the site and review the issues .
