SUBJECT: Disposal of Surplus School Property
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Request the Director, Community Development Department, to
take into account, in making recommendations on planning
issues, the needs of some school districts for additional
funds for new construction and rehabilitation of existing
facilities.
2. Request the Director, Redevelopment Agency, to take into
account, in planning redevelopment projects, the needs of
some school districts for additional funds for new
construction and rehabilitation of existing facilities.
3. Remove this item as a referral to our Committee.
BACKGROUND:
On July 24, 1984, the Board referred to the Internal Operations
Committee a request to study the procedure for disposing of
property for school sites.
On April 22 , - 1985, our Committee met with the Superintendent of
Schools, the Director of the Redevelopment Agency, and the
Director of the Community Development Department. County Counsel
supplied an opinion dated February 28 , 1985 indicating that State
law already sets forth in some detail the procedures school
districts must use in disposing of surplus property, and that
there is very little the Board of Supervisors can do to effect
any changes in those procedures without additional State
legislation.
The Superintendent of Schools, Dr. Ron Stewart, agreed with
County Counsel' s opinion. He noted that while it clearly would
be best to operate on a countywide basis and consider all assets
available for use countywide, such a concept would require vast
changes in State legislation, which are unlikely to be enacted in
the foreseeable future.

We also discussed with Mr. Progen, the Redevelopment Director,
the need to keep in mind school districts ' needs for funds when
redevelopment projects are being planned.
Our Committee is concerned that some school districts are selling
property and shutting down schools while other school districts,
which are experiencing growth, are desperately trying to acquire
necessary sites and build badly needed facilities. However, it
appears that the only concrete action the Board of Supervisors
can take involves the above recommendations to the Community
Development Department and the Redevelopment Agency. Other
solutions, such as pressing for a consolidation of some, or all,
of the school districts in the County, while feasible legally, is
probably impractical and would not be supported by the voters.
