THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA

Area D-3, Including the Certification of the )
Environmental Impact Report for said Plan. )

The Board of Supervisors of Contra Costa County as the Governing
Board of the Contra Costa County Flood Control District RESOLVES that:
On February 19, 1985, the Board of Supervisors passed its Resolution
85/89 proposing the adoption of the plan of improvements for the West
Antioch Creek Improvements in County Service Area D-3, including the
Certification of the Final Environmental Impact Report covering the adoption
of said plan of improvements. The Board has considered the Final Environ-
mental Impact Report and the Engineer's Report, entitled "Engineer's
Report for Improvements on Lower West Antioch Creek, Contra Costa County
Service Area D-3, " dated June 1984, which was included in the Final
Environmental Impact Report.
On April 23, 1985, this Board conducted a public hearing to consider
and act upon the Final Environmental Impact Report and heard and passed upon
_ any and all of the written or oral objections presented concerning the '
West Antioch Creek Improvements. Prior to the conclusion of said hearing,
written protests to prevent adoption of the plan of improvements were not
filed, and any protests received were overruled and denied.
Neil Park, Attorney for U. S. Steel Corporation - Chiltern Development
Corporation, informed the Board that the Environmental Impact Report, as
it presently exists, does not acknowledge their development plan. It
assumes no development there. He stated that he does not want that
omission to jeopardize the Delta Landing Project proposed by the U.S. Steel
Corporation - Chiltern Development Corporation.
Supervisor Powers inquired if the U.S. Steel Corporation - Chiltern
Development Corporation project came up after the West Antioch Creek
Improvements project environmental impact report.
Mr. Neil Park agreed that it did.
It appears from the affidavits of publication on file with this Board
that all notices required to be given for such hearing have been duly and
regularly given and all procedures to be followed have been followed, all
in accordance with Government Code SS6061 and in accordance with the
provisions of Resolution No. 85/89.

i The Board hereby CERTIFIES that the Environmental Impact Report,
submitted to it by the Flood Control District, as to the environmental
impact of the West Antiodh Creek Improvements project has been completed
in compliance with the California Environmental Quality Act, and it has
reviewed and considered the information contained therein. This Board
ACKNOWLEDGES that the project would have certain environmental effects and
ADOPTS the findings and mitigation measures expressed in Planning Commission
Resolution No. 18-1985 which mitigate those effects.
The Board hereby' FINDS that good cause exists for the approval of the
project and ORDERS that the plan for Alternate 2 - Earth channel of the
aforementioned "Engineer's Report" is hereby INSTITUTED.
This Board hereby DIRECTS the Chief Engineer to file with the County
Clerk a Notice of Determination for this project.
As recommended by Supervisor Torlakson, staff is DIRECTED to continue
discussion with the fairgrounds management with respect to alignment of the
creek and environmental concerns and goals, to hopefully derive a
satisfactory conclusion.
