The Board of Supervisors of Contra Costa County FINDS that:
Government Code Section 66484 and Division 913, Title 9, of the Contra Costa
County Code provide for assessing and collecting fees for bridge and/or major
thoroughfare construction within a designated Area of Benefit as a condition of
approval : of a final subdivision map or as a condition of issuing a building
permit; and
The Public Works Director with the Director of Planning, has completed a
Development Program Report for the Richmond/El Sobrante Area of Benefit which was
filed with the Clerk of the Board on March 26, 1985, and notice of the proposed
hearing was duly given in accordance with Section 913-6.014 of the Contra Costa
County Ordinance Code; and
A Negative Declaration pertaining to this project was published with no
protests received during the review period and the Board hereby CONCURS in the
findings that the project will not have a significant effect on the environment
and hereby DIRECTS the Public Works Director to file a Notice of Determination
with the County Clerk; and
This Board hereby DETERMINES that a majority protest does not exist, inasmuch
as a written protest has not been filed by the owners of more than one-half of
the area of the property to be benefited by the improvement; and
This Board hereby ADOPTS the Development Program Report of March 1985
pertaining to the Richmond/El Sobrante Area of Benefit, its boundaries, estimated
cost of improvements, costs allocation, and method of fee apportionment with
the amendment that the interest accrued on the fees collected in this Area of
Benefit shall continue to accumulate in the same account and shall be used to
cover the cost of administration, design and construction of the fee area improve-
ments; and
The Board - hereby Adopts the following fee schedule as recommended in the
Development Program Report: Residential single-family, $1 ,749/unit; Residential
multi-family, $1,224/unit; and Commercial , $1.25/square feet of gross floor.area.
Supervisor Powers having recommended that:
a. The Public Works Director on behalf of the Board, approach the City of
Richmond on revising their current fee schedule, within the area
identified as Richmond/E1 Sobrante Area of Benefit boundary, to conform
,with the County's fee schedule adopted by this Resolution;

b. The El Sobrante Traffic Advisory Committee be requested to:
i . Work closely with the County's Public Works Department and the
Community Development Department to prioritize the projects and
recommend, to the Board of Supervisors, projects that should be
added or deleted to Appendix C of the said Development Program
Report;
ii . Work with Staff in reviewing the fee schedule after six months
and if necessary, make recommendations to the Board for changes' in
fee schedule after one year after adoption of the Area of Benefit.
C. Staff discuss with Building Industry Association the various issues as
raised by the Building Industry Association.
d. Staff evaluate the feasibility of a revolving fund concept for funding
the proposed improvements in the Area of Benefit.
e. Any amendments to the currently adopted General Plan within the Area of
Benefit must reflect their impact on traffic and the fee schedule of
the Area of Benefit.
NOW, THEREFORE, IT IS HEREBY RESOLVED that an Area of Benefit is hereby
ESTABLISHED in the unincorporated area of the County of Contra Costa pursuant to
Section 913-6.024 of the Contra Costa County Ordinance Code, the boundaries of
which are described in the Development Program Report pertaining to the Richmond/E1
Sobrante Area of Benefit.
IT IS FURTHER RESOLVED that the above recommendations of Supervisor Powers
are approved and the Clerk of this Board is DIRECTED to file a certified copy of
this Resolution with the County Recorder as specified in Section 913-6.026 of the
Contra Costa County Ordinance Code.
