SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for SB 2092 (Lockyer).
BACKGROUND:
Under existing law, there. is a special negotiator who negotiates rates, terms,
and conditions for contracts with hospitals for inpatient services rendered to
Medi-Cal program beneficiaries. In negotiating these contracts, the negotiator is
required to consider certain specified factors, including but not limited to:
(1 ) Beneficiary access.
(2) Utilization controls.
(3) Ability to render quality services efficiently and economically.
(4) Demonstrated ability to provide or arrange needed specialized services.
(5) Protection against fraud and abuse.
(6) Any other factor which would reduce costs, promote access, or enhance
the quality of care.
(7) The capacity to provide a given tertiary service, such as specialized
children's services, on a regional basis.
(8) Recognition of the variations in severity of illness and complexity of care.
(9) Existing labor-management collective bargaining agreements.
SB 2092 would add a tenth factor to be considered, as follows:
"(10) The situation of county hospitals, which are burdened to a
greater extent than private hospitals with bad debts, indirect costs,
medical education programs, and capital needs."
SB 2092 passed the Senate Health & Human Services Committee April 26 by a vote of
7:0. It was not required to be heard in Senate Finance since it has no direct fiscal
impact and is now on the Third Reading file on the Senate floor.
To the extent that SB 2092 may influence the Medi-Cal negotiator to provide a higher
rate of reimbursement to County Hospitals, it deserves the support of the Board of
Supervisors. The Acting Health Services Director urges the Board to support SB 2092.
