HomeMy WebLinkAboutRESOLUTIONS - 05011984 - 84-260 /, a3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 1, 1984 , by the following vote: AYES: Supervisors Powers, Fanden, Schroder, Torlakson NOES: None ABSENT: Supervisor McPeak ABSTAIN: None SUBJECT: Determination of Property Tax Transfer for Annexation No. 260), RESOLUTION NO. 84/ 260 to West Contra Costa Sanitary ) District (LAFC 84-5) WHEREAS, Section 99.1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one ormore services to an area where such services have not been previously provided shall not become effective if one or more affected special districts involved in the property tax exchange negoti- ation fails to adopt a resolution agreeing to a transfer; and WHEREAS, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer except for the annexing district; and WHEREAS, Annexation No. 260 to West Contra Costa Sanitary District (WCCSD) (LAFC 84-5) proposes annexation of territory which results in provision of services not previously provided and no resolu- tiona have been adopted agreeing to property tax exchanges; and WHEREAS, in the absence of a master agreement for property, tax exchange between the County and WCCSD, the County and WCCSD have agreed that the property tax exchange agreement for this annexation will be in accordance with the terms of the existing master agreement between the County and the Central Contra Costa Sanitary District and the East Bay Municipal Utility District. THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that the property tax increment allocation factors for the affected agencies in the area of Annexation No. 260 to the West Contra Costa Sanitary District (.LAFC 84-5) for the 1985-1986 fiscal year and subsequent years shall be in accordance with the above master agreement between the County and the Central Contra Costa Sanitary District and the East Bay Municipal Utility District to the subject annexations, said increment tax allocation factors apply to affected territory as submitted or revised by the Local Aq.ency Formation Commis- sion.
