Code Section 25526.5) SUBJECT: Sale of County Surplus Real Property Rule Court Walnut Creek Area Project No. 0662-6U4157 The Board of Supervisors of Contra Costa County RESOLVES THAT: On June 14, 1983, the Board adopted Resolution No. 83/838, which vacated Rule Court, Walnut Creek. This Board hereby DETERMINES that the portion of Rule Court described in Exhibit "A" attached hereto, is no longer necessary for the County or other public purposes and its estimated value does not exceed Ten Thousand Dollars . In consideration of payment of $2,500.00 which has been paid in full , the Board hereby APPROVES the sale of said property to Kern W. Schumacher and Joy N. Pritchard and AUTHORIZES the Chairman to sign a Quitclaim Deed on behalf of the County. The Real Property Division is DIRECTED to cause said deed to be delivered to grantee. The Board hereby FINDS that the project is exempt from Environmental Impact Report requirements as a Class 12 Categorical Exemption under County Guidelines and DIRECTS the Public Works Director to file a Notice of Exemption with the County Clerk. Vacation No. 1895 , 3A RULE COURT Quitclaim EXHIBIT "A" A portion of .the County of. Contra Costa road known as Rule Court formerly known as Boulevard Way, being a portion of Parcel 3 as said parcel was described in the "RELINQUISHMENT OF STATE HIGHWAY IN THE COUNTY OF CONTRA COSTA, ROADS IV-C, C-75, 107-A, B;A RELINQUISHMENT NO. 22124" recorded September 4, 1962 in Book 4195 at page 323 of Official Records of Contra Costa County, California, described as follows: Beginning on the northwesterly right of way line of Rule Court at the north- easterly terminus of the course with a bearing and distance of "North 310 45' 19" East, 254,183 feet" as described in said Parcel 3 (4195 O.R. 323) at the southerly right of way line of State of California Highway 24 from which a radial line of a curve concave to the north having a radius of 2086.00 feet bears North 60 22' 49" East; thence easterly along said curve and right of way line through a central angle of 20 34' 54", an arc distance of. 93.99 feet to the southeasterly right of way line of said Rule Court, 84.00 feet in right of way width; thence, along said southeasterly line, South 310 45' 19". West 76.79 feet; thence, leaving said line, southerly along a tangent curve concave to the east having a radius of 10.00 feet through a central angle of 990 43' 270, an arc distance of 17.41 feet to a point of cusp; thence, tangent to said curve, North 670 58' 08" West 25.73 feet to a point from which a radial line of a curve concave to the south having a radius of 67.00 feet bears South 140. 06' 42" West, thence westerly along said curve, through a central angle of 640 33' 4211, an arc distance of 75.50 feet; thence North 500 27' 00" West 24.47 feet to the point of intersection of the said northwesterly right of way line of Rule Court with the northerly line of Lot 11 as said Lot is shown on the map of Floraland Tract Subdivision filed July 19, 1913 in Book 10 of Maps at page 241, records of Contra Costa County; thence along said northwesterly line of Rule Court North 310 .45' 19" East 100.25 feet to the point of beginning. Containing an area of 7,900 square feet of land, more or less. Bearings and distances used in the above description are based on the California Coordinate System Zone III. To obtain ground distance multiply distances used by 1.0000746. RESERVING THEREFROM, pursuant to the provisions of Section 8340 of the Streets and Highways Code, the easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any highway or part thereof proposed to be abandoned and pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, -conduits, cables, -wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines and for the transportation or distribution of electric energy, petroleum and its products, a7wTonia, water, and for incidental purposes, including access to protect the property from all hazards in, upon-and over the area hereinbefore described to be quitclaimed. Also reserving therefrom a roadway easement appurtenant to and from the parcel 4f' described in the deed recorded in Book 3810 at page 6, and the parcel described in the deed recorded in Book 1871 at page 109, Official Records of Contra Costa County, to the nearest Contra Costa County maintained road. 00
