Drive) and Boeger Place as county roads, Subdivision 92-07737, for project being developed by

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 2007/ ZP.Z for Subdivision 92-07737, accepting completion of improvements and
declaring Jill Avenue(from Boeger Place to Driftwood Drive)and Boeger Place as county roads,for project being
developed by KB Home North Bay, Inc., Bay Point area. (District V)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The improvements have been installed in a good workmanlike manner as required by the improvement plans and in
confirmation with the County Ordinance Code.
CONSEQUENCES OF NEGATIVE ACTION:
Improvements will not be accepted as complete.

SUBJECT: Accepting completion of improvements and declaring Jill Avenue (from Boeger
Place to Driftwood Drive)and Boeger Place as county roads,Subdivision 92-07737,
for project being developed by KB Home North Bay, Inc., Bay Point area. (District

The Public Works Director has notified this Board that the improvements in Subdivision 92-
07737 have been completed as provided in the Subdivision Agreement with KB Home North Bay,
Inc., heretofore approved by this Board in conjunction with the filing of the Subdivision Map.
The Public Works Director having notified this Board that the improvements for Subdivision
92-07737, being developed by KB Home North Bay, Inc., have been completed and that such
improvements have been constructed without the need for a fourth extension of their Subdivision
Agreement;

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of April 3,2007 thereby establishing the six-month terminal period for the filing of liens in case of
action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment (labor and materials) surety for$197,022.00,
Bond No. 929358073 issued by the above surety be RETAINED for the six month lien guarantee
period until October 3,2007,at which time the Clerk of the Board is AUTHORIZED to release the
surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that Jill Avenue and Boeger Place the hereinafter described
roads, as shown and dedicated for public use on the Final Map of Subdivision 92-07737 filed July
20, 1994, in Book 374 of Maps at Page 15-22, Official Records of Contra Costa County, State of
California, are ACCEPTED and DECLARED.to be County roads.

BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby

929358073 issued by Continental Insurance Company.
All deposit permits are on file with the Public Works Department.
