AUTHORIZING ADVERTISING ON BUS SHELTERS
The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical
footnotes from the official text of the enacted or amended provisions of the County
Ordinance Code):
SECTION I. SUMMARY. This ordinance amends several sections of the County
Ordinance Code to authorize advertising to be placed on bus shelters within road rights-of-
way.
SECTION II. Section 82-12.402 of the County Ordinance Code is amended to read:
82-12.402 Generally. (1) Prohibition. No building or structure (other than
excepted structures as herein defined) shall hereafter be erected, constructed,
or placed on any land in the unincorporated area of this county between the
highway setback lines hereby established and the common boundary line of the
land and any state highway or public road in this county. The highway
setback lines shall be lines parallel to the boundary lines of highways and
public roads. In determining the location of highway setback lines the distance
from the boundary of the state highway or public road to the setback line shall
be measured inward on the land, at right angles to the boundary lines. The
setback line on lands bounded on one or more sides by a state highway shall
be five feet inward from each boundary line. The setback line on land
bounded on one or more sides by a public road other than a state highway
shall be ten feet inward from each boundary line.
(2) Exception. The prohibition in subsection (1) shall not apply to a bus
shelter erected or placed in accordance with an encroachment permit issued pursuant
to chapter 1002-2 of this code.

SECTION III. Section 82-12.406 of the County Ordinance Code is amended to read:
82-12.406 Outdoor advertising. (1) Prohibition. No structure used for
outdoor advertising, including fences or gateways on which advertising in
placed, shall be constructed or maintained between the highway setback lines
and the boundary line of any state highway or public road. All structures and
all outdoor advertising now in existence between any highway setback lines
and the boundary line of any highway or public road shall be removed and
placed beyond the highway setback lines within twelve months after the
effective date of this section; the maintenance of any structure used for outdoor
advertising between highway boundary lines and highway setback lines after
that time shall be a violation of this section. No outdoor advertising structure
or sign shall hereafter be erected, located on, moved into, or maintained in
any single family residential district, multiple family residential district,
agricultural district, residential suburban district, transition residential- ,
agricultural district, or forestry recreation district.
(2) Exception. The prohibition in subsection (1) shall not apply to advertising
signs placed on a bus shelter in accordance with the outdoor advertising ordinance
(chapter 88-6) and with an encroachment permit.

SECTION IV. Section 88-6.812 is added to the County Ordinance Code to read as follows:
88-6.812 Sign -- bus shelters. Advertising signs placed on a bus shelter shall not
cover more than 54 square feet of surface area of the shelter. (Ord. 93-_ § 4,

SECTION V. Section 88-6.1204 of the County Ordinance Code is amended to read:
88-6.1204 Sign erection prohibited on rights-of-way. Except as herein
expressly provided in section 88-6.816 and this section, no outdoor advertising
structure authorized or permitted by this chapter shall be erected within the
lines of the right-of-way of any state highway, county highway, public road,
or street. This prohibition does not apply to advertising signs placed on a bus
shelter in accordance with this chapter and with an encroachment permit.

SECTION VI. Section 1002-2.010 of the County Ordinance Code is amended to read:
1002-2.010 Unacceptable permit applications; exception. (1) Prohibition.
No application will be accepted, nor any permit issued for constructing or
maintaining a loading platform within or on the right-of-way; or for erecting,
using or maintaining a post, pole, column, or structure for the support of
advertising signs within or on the right-of-way; or for erecting, using, or
maintaining advertising signs which overhang the right-of-way. Any such
encroachment is illegal.
(2) Exception. Advertising signs that are in compliance with the outdoor
advertising ordinance (chapter 88-6 of this code) are permitted on a structure within
or on the right-of-way that is used solely as a bus shelter.

SECTION VII. EFFECTIVE DATE. This ordinance becomes effective 30 days after
passage, and within 15 days of passage shall be published once with the names of the
supervisors voting for and against it in the Contra Costa Times , a
newspaper published in this County.
