HomeMy WebLinkAboutORDINANCES - 09181986 - 86-84 ORDINANCE No. 86- 84 (Human Relations Co—m—M`ssiM) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted provisions of the County Ordinance Code): SECTION I. Summary. This ordinance creates a human relations commission as authorized by California Government Code Sections 50260 et. seq. to foster peaceful relations and to promote positive human relationships among citizens of different races, religions and national origins. SECTION II. Chapter 26-8 is added to the Contra Costa County Ordinance Code, to read as follows: Chapter 26-8 Human Relations Commission Section 26-8.002 Declaration of Policy. It is the public policy of the county that all persons residing or visiting in the county, irrespective of their age, race, religion, color, sex, ancestry, national origin, handicap, or sexual orientation, may enjoy an equal opportunity to live, grow, learn, work, play, worship and exercise the responsibilities of citizenship, unhampered by Invidious discrimination. To effectuate this policy the Contra Costa County Human Relations Commission is hereby established pur- suant to Government Code Sections 50260 et. seq. (Gov.Code Sections 50260-50265, Ord. 86- 84 SII, Ord. 81-64, Ord. 69-62) Section 26-8.004 Scope of Activities. This Human Relations Commission shall operate within the County's unincor- porated area and shall coordinate and cooperate with all cities within the County. The Human Relations Commission shall operate within any incorporated city which adopts a resolution in support of this ordinance and requests par- ticipation of the Human Relations Commission. (Govt.Code Sections 50260, 50261 and 50262, Ord. 86- 84 SII) Section 26-8.006 General Purposes. The general purposes of the Contra Costa County Human Relations Commission shall be to foster peaceful relations In the interest of preserving the public peace among citizens of different races, religions, and national origins; and to pro- mote positive human relationships for the purpose of insuring public peace, health, safety and the general welfare. (Govt.Code Sections 50260 and 50261, Ord. 86 - 84 SII, Ord. 81-64, Ord. 69-62, Cal.Atty.Gen. I.L. 74-191, County Counsel Op..'86:54. Section 26-8.008 Responsibilities. The responsibilities of the Contra Costa County Human Relations Commission shall be as follows: (a) To foster mutual respect and understanding among all racial, religious and nationality groups in the community. ORDINANCE No. 86-§,4 (b) To make such studies in any field of human relationship in the com- munity as in the judgment of the commission will aid in effectuating its general pur poses. (e) To inquire into incidents of tension and conflict among or between various racial, religious and nationality groups, and to take action by means of conciliation, conference, and persuasion to alleviate such tensions and conflict. (d) To conduct and recommend such educational programs as, in the judgment of the commission, will increase good will among inhabitants of the community and open new opportunities into all phases of community life for all inhabi- tants. (Govt.Code Section 50264, Ord. 86- 84 SII, Ord. 81-64, Ord. 69-62, Cal.Atty. Gen. I.L. 74-191, County Counsel Op. 86-94 ) Section 26-8.010 Obligations. The obligations of the Contra Costa County Human relations Commission shall be as follows: (a) To hold conferences, and other public meetings, in the interest of the constructive resolution of racial, religious and nationality group tensions and the prejudice and discrimination occasioned thereby. (b) To issue such publications and reports of investigation as in its judgment will tend to effectuate the purposes of this article. (c) To enlist the cooperation and participation of the various racial, religious and nationality groups, community organizations, industry and labor organizations, media or mass communication, fraternal and benevolent asso- ciations, and other groups in an educational campaign devoted to fostering among the diverse groups of the community mutual esteem, justice and equity. (d) To encourage and stimulate agencies under the jurisdiction of the Contra Costa County Board of Supervisors and the City Councils of Cities which adopt this chapter to take such action as will fulfill the purposes of this chapter. (e) To submit an annual report to the Contra Costa County Board of Supervisors and to the City Councils of Cities which adopt this chapter. (Govt.Code Section 50265, Ord. 86-_1 _SII, Ord. 81-64, Ord. 69-62 , Cal.Atty. Gen. I.L. 74-191, County Counsel Op. 86-24 Section 26-8.012 Commission, Membership, Composition, and Appointment a. The commission shall consist of fifteen (15) members. b. The membership shall be broadly representative of the general public Including, but not limited to members of business, labor, religious groups, edu- cation, criminal justice, community organizations, and city representatives characteristic of the County's diverse population with respect to sex, sexual orientation, ethnicity, disability, economic disadvantage or age. c. Commission members shall be appointed by the Board of Supervisors as a whole from among individuals formally applying for or nominated for membership, taking into consideration, among other things, the various religious, racial, nationality and political groups in the County. All members of the commission must be county residents and at least one commission member must reside in each supervisorial district. (Govt.Code Section 50262, Ord. 86-84 SII, Ord. 81-64, Ord. 69-62) ORDINANCE No. 86-84 Section 26-8.014 Terms. a. The Commissioners, upon appointment, shall serve a term of three (3) years until their successors are duly appointed; but the first Commissioners shall classify themselves by lot so that five members serve for three (3) years, five serve for two (2) years and five serve for one (1). Any vacancy shall be filled for the unexpired term in the same manner as the original appointment. b. Commissioners may not be appointed to more than two (2) full three year terms. This .does not include initial appointments by lot or unexpired terms of less than three (3) years. c. A vacancy shall exist and shall be reported to the Board of Supervisors whenever a commissioner has three (3) consecutive absences from regular meetings of the commission. (Govt.Code Section 50262, Ord. 86- 84 SII, Ord. 81-64, Ord. 69-62) Section 26-8.016 Organization and Meetings. a. The Contra Costa County Human Relations Commission shall meet at least once a month. The commission shall select its chair, and shall adopt, by a majority vote, such rules as it shall deem expedient for the conduct of its business. b. The commission may establish standing or ad hoc committees of its members at its discretion, and define their area of operation and concern. c. All meetings of the commission shall be public except as provided by law. (Govt.Code Section 50262, Ord. 86- 84 SII, Ord. 81-64, Ord. 69-62) Section 26-8.018 Compensation. Commission members shall receive a stipend for attendance at any Human Relations Commission or standing committee meeting in the amount of ten dollars ($10.00) per meeting but not to exceed four (4) meetings per month. (Govt.Code Sections 50261, 50262, 50263, Ord. 86- 84 SII, Ord. 81-64, Ord. 69-62) SECTION III. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days of passage shall be published once with the names of the supervisors voting for and against it in the Contra Costa Times , a newspaper published in this County.
