ORDINANCE NO. 84- 23
(Correcting Numbering of Division 522 , added by
Ordinance No. 83-36 )
The Contra Costa County Board of Supervisors ordains as follows
(omitting the parenthetical footnotes from the official text of
the enacted or amended provisions of the County Ordinance Code) :
SECTION I . Purpose. The purpose of this ordinance is to renumber
Division 522,Time-of-Sale Residential Weatherization Disclosure,
added by Section II of Ordinance No. 83-36, to Division 524.
SECTION II . Section 51-4.404 is amended, to provide that viola-
tions o'f Division 524, and not Division 522 , are infractions , to
read:
51-4.404 Most violations infractions . Pursuant to Section
14-8.002 of this code, violations of this Title 5 are mis-
demeanors , except violations of Chapter 54-10 (Rewards ) , Division
58 (CATV Systems ) , and Division 524 (Time-of-Sale Residential
Weatherization Disclosure) , which are infractions .

SECTION III . Division 522 , Time-of-Sale Residential
Weatherization Disclosure, added by Section II of Ordinance No.
83-36, is hereby repealed, but the identical provisions are re-
adopted in Section IV, as Division 524. Section III of Ordinance
No. 83-36 is also hereby repealed, but the identical provision is
re-adopted in Section V as to Division 524.
SECTION IV. Division 524 is added the Ordinance Code, to read :

WEATHER.IZATION DISCLOSURE
(Effective through August�31, 1986)
Chapter_524_2 Policy_and_Purpose
524-2.002 Policy-and-Purpose. Voluntary weatherization of
existing residential dwellings saves energy, promotes the economic
and general welfare of the County and protects the public health.
The purpose of this division is to encourage the voluntary
weatherization of residential dwellings by requiring that sellers
of residential dwellings provide prospective buyers with infor-
mation on the existence of specific . energy saving weatherization
devices within such dwellings.

Chapter524-4 Requirements
524-4.00_2 Weatherization dis_closure_requirements_ Every
seller of�a residential dwelling building containing one through
four dwelling units shall provide to all prospective buyers of the
dwelling, on an approved standardized form, written information on
whether all of the following energy saving devices exist on or
in each dwelling unit :
(1 ) All accessible attic space above living area is insu-
lated, and if so, the thermal resistance (R) value (as defined in
Section 2-5302 of Title 24 of the California Administrative Code,
as amended or recodified from time to time) of the insulation
material .
(2) All doors and windows leading to unheated areas are
weatherstripped.
(3) Hot water heater tanks are fitted with an insulation
blanket or other insulation material .
(4) All accessible shower heads have flow restrictors or low
flow shower heads .
(5) All accessible heating and cooling ducts in unheated
areas are insulated .
(6) All major joints and openings to the dwelling' s exterior ,
including switchplates and wall outlets , are caulked or sealed.

524-4.004 Acknowledgment_by_buyer_ Every buyer of a residen-
tial dwelling containing one through four dwelling units shall
submit written acknowledgment , of receipt of the information
required by Section 524-4.002, to the County Public Works
Director , within 14 days after close of escrow or transfer of
title to the property.

524-4.006 Standardized Form. The Public Works Director shall
establish a+standardized form to be used by sellers and buyers to
comply with the requirements of this division.

Chapter_524_6 Effect
524-6.002 Noncoompliancez_effect_on_transfer . Failure of the
seller an or buyer to comply with the pr—ovisions of this division
shall not affect the validity of the transfer of the property.

524-6 .004 Use of information. Information obtained pursuant
to thisdivisionmay be used for any lawful purpose, including,
but not limited to, compilation of statistics to evaluate and
monitor the effectiveness of this division.

SECTION_V. In order to assist those persons affected by the pro-
visions of Section IV to become aware of and understand said pro-
visions , the Public Works Director is authorized to cooperate with
the private sector ( including but not limited to the press , and
the County' s Board of Realtors ) and other public entities , in
publicizing its requirements .
SECTION VI . EFFECTIVE DATE. This ordinance becomes effective 30
days after passage', andwithin15 days after passage shall be
published once with the names of the Supervisors voting for and
against it in the CONTRA COSTA _TIMES _______, a newspaper
published in this County:
SECTION VII . REPEAL. This ordinance is hereby repealed on August
31, -1986 ,' unless—otherwise amended, repealed or extended before
then.
