THE BOARD OF SUPERVISORS OF CONTRA COSTA. COUNTY, CALIFORNIA
Adopted this Order on A2ril 17, 1984 , by the following vote:
AYES: Supervisors Powers, Fanden, McPeak, Torlakson
NOES: None
ABSENT: Supervisor Schroder
ABSTAIN: None
SUBJECT: Workshop and Status Report from the Director of Planning
and the Public Works Director on the proposed Master Plan
for school facilities in the Oakley and East County area.
This being the time fixed for a workshop and Status report
from the Director of Planning and the Public Works Director on the
proposed Master Plan for school facilities in the Oakley and East
County area; and
Anthony A. Dehaesus, Director of Planning, advised that
there would be a public hearing before the Board on May 15, 1984,
regarding the East County Educational Facilities Component of the
Community Facilities Element of the County General Plan, and having
commented that fees were now being collected under Senate Bill 201,
producing approximately $1, 200. 00 per dwelling unit for school faci-
lities, and also having commented that last year a bill was intro-
duced to eliminate the word interim from the State Statute, which
would then presumably mean that a fee could be established for per-
manent facilities and that this bill has essentially died in
Committee; and
Supervisor Powers requested that the issue of charging
permanent fees for school facilities be referred to County Counsel
for a definitive opinion as to the legality of charging such fees;
and
Daniel Vanderpriem, Senior Planner, advised that the
Oakley, Bryon, Brentwood and Liberty School Districts are in need of
additional classrooms and advised that within the next 5 to 10 years
a total of approximately $85, 000,000. 00 would be needed for school
construction in the East County area; and having also briefly sum-
marized some of the alternative methods of financing for school
facilities; and
Supervisor Torlakson having commented on Assembly Bill
311, which has ballot consideration by the Governor of
$850, 000, 000. 00 for school facilities and advised that he had writ-
ten a letter in support of Assembly Bill 311; and
Ron Stewart, County Superintendent of Schools, appeared
and advised the Board that Assembly Bill 311 was initially targeted
as $850,000, 000. 00, and when it went to Committee was cut to
$500,000, 000. 00, and subsequently did not pass, the reason being
that there were too many bond issues, and also stated that, to his
knowledge, the latest figure for school facilities under Assembly
Bill 311 was some where in the neighborhood of $350, 000, 000. 00,
which would not impact the needs for school facilities in the East
County area; and
Mr. Stewart also commented that, in his opinion, he felt
the Board was working old ground and that they needed to put their
heads together and start working new ground in order to resolve any
of the issues with respect to school facilities in the East County
area; and

Supervisor McPeak commented that, in her opinion, some
kind of an approach was needed to come up with an alternative
financing method that would require the participation of everyone
actually benefitting from the facilities, and stated that an alter-
native of this nature may require new legislation, and further com-
mented that she thought the Board might have the vehicles to
initiate new legislation; and
Anthony A. Dehaesus, Director of Planning, suggested that
an inventory be taken of the available portable classrooms that pre-
sently exist in the County and also suggested that the School
Districts work together with the developers in the area so that they
could perhaps provide portable classrooms in lieu of fees; and
Joyce Mandesian, Superintendent of Oakley Union School
District, appeared and advised that the Oakley School District can
no longer wait for long term solutions to the problem of school
facilities, that there are specific costs that are incurred by the
school districts with respect to the installation of portable
classrooms, and suggested that some sort of package be developed
whereby the rates for the portable classrooms would be kept at a
reasonable cost to the School Districts, and also advised the Board
that she was anticipating anywhere from 60 to 150 new students in
September 1984, commenting that she needed resorces immediately; and
Dean J. Bettker, Superintendent, Liberty Union High School
District, appeared and suggested that the entire Board send a letter
in support of Assembly Bill 311, which he felt would be more
favorable than having each Supervisor send a letter individually,
and suggested that the Board, the developers in the area, the school
districts, and the community, all work together in order to find
some alternative solutions to the school facilities problem in East
County; and
Eric Hasseltine, . representing The Hofmann Company, and the
Building Industry Association, appeared and requested that the Board
look at the whole infrastructure need that the County is presently
facing, and also having commented on the growth structure in the
East County area, and stated that now is an excellent time to define
what is going to be needed in terms of infrastructure for the East
County area; and
Mr. Hasseltine also suggested that some program be ini-
tiated whreby the community, the schools, and the developers in the
area would all participate and pay a share for community facilities,
and commented that the Building Industry Association was ready to
make a commitment to a permanent facility, but not to in interim
facility; and
Anthony A. Dehaesus thereupon recommended that in the short
term (during this school year) that:
1. The County Superintendent of Schools is requested to
establish a county-wide inventory of portable class-
rooms and provide a clearinghouse to aid impacted
districts in purchasing portables no longer needed
by other school districts; and that
2. The County Superintendent of .Schools, together with
affected school districts, is requested to begin
formal negotiations with development interests to
arrive at voluntary agreements regarding direct provi-
sion of portable classrooms to the school districts;
and that
3. The County Planning Department is directed to explore
amending the school fee impaction ordinance to allow
developers to provide portable classroom space
directly to school districts in lieu of impaction .
fee payment. This may result in providing more class-
room space per dollar than under the current system
whereby a school district would lease classrooms with
impact fee monies; and that in the long term (during
1984) ;

4. The Board of Supervisors should request the county
redevelopment attorney to prepare a report on how the
redevelopment agency could be used as a vehicle to
provide temporary or permanent educational facilities;
and that
5. The County Superintendent of Schools be requested to
organize and chair a task force to pursue long term
solutions to the school facilities financing issues
in the East County area; and
Supervisor Torlakson having requested 'that an additional
component be added to ask the Xounty Planning and Public Works
Department to report back to the Board on May 15, 1984, with an
outline of the potential utilization.
Board members having considered the matter, IT IS ORDERED
that the recommendations of the Director of Planning and Supervisor
Torlakson are APPROVED.
