SUBJECT: DIRECT the Public Works Director to terminate the Brentwood Sphere of Influence Fee Program,
unincorporated Brentwood area. (District 111)

RECOMMENDED ACTION:
DIRECT the Public Works Director to arrange for the closure of the Brentwood Sphere of Influence Trust
Account (Fund No. 0646), unincorporated Brentwood aea.
DIRECT the Public Works Director to terminate the Brentwood Regional Traffic Mitigation Fee Agreement
between Contra Costa County and the City of Brentwood.
FISCAL IMPACT:
There will be no fiscal impact upon the General Fund as a result of this action.
REASONS FOR RECOMMENDATIONS AND BACKGROUND:
On March 14, 1989, the Board of Supervisors approved and authorized the execution of the Brentwood
Regional Traffic Mitigation Fee Agreement between Contra Costa County and the City of Brentwood. This
agreement established the Brentwood Sphere of Influence fee program. Fees collected by the City of
Brentwood were to be used to lie 1p fund the Delta Expressway (State Rout 4 Bypass)-Prr ect including the

east-west connector to State Route 4. Fees collected by Contra Costa County were to be used to help fund
projects within the Brentwood Sphere of Influence boundary and on the East, County Area of Benefit or
Oakley/North Oakley Area of Benefit project lists.
Contra Costa County did not intend to have the Brentwood Sphere of Influence fee program be a separate fee
nor have its own set of fee rates. Instead, projects located within the Brentwood Sphere of Influence boundary
were charged either to the East County Area of Benefit or Oakley/North Brentwood Area of Benefit fee rates
(e.g. projects located within the Brentwood Sphere of Influence and East County Area of Benefit are charged
the East County Area of Benefit fee rate).
In February 2005, the Board of Supervisors approved a board order directing the Public Works Director to
terminate the Oakley/North Brentwood Area"of Benefit program since the City of Oakley incorporated areas of
the Oakley/North Brentwood Area of Benefit boundary, and City of Brentwood took responsibility for the
remainder.
The agreement between Contra Costa County and the City of Brentwood would expire when the following have
been satisfied:
1. The City of Brentwood establish and cause to,be collected from all new development within
incorporated limits of the City of Brentwood a fee (i.e. adopt implementing ordinances, resolutions or
urgency measures to collect the traffic impact fee and condition new developments to pay the fee at the
time of building permit issuance).
2. Contra Costa County expended the fees for their intended purposes.
Contra Costa County and the City of Brentwood have since satisfied the terms stated above:
I. The City of Brentwood has since adopted the necessary ordinances and resolutions to implement the
traffic impact fee to help fund the Delta Expressway (State Route 4 Bypass) Project. That fee is the East
Contra Costa (ECC) Sub-Regional Transportation Mitigation, East County Transportation Improvement
Authority (ECTIA), and/or East Contra Costa Regional. Fee and Financing Authority/Regional
Transportation Development Impact Mitigation (ECCRFFA/RTDIM) fee. They are collecting the fee
towards this project and requiring new developments to pay this it at building permit issuance.
2. Contra Costa County has expended the funds for their intended purposes.
Approval of this board order will close the Brentwood Sphere of Influence fee program and terminate the
agreement.
CONSEQUENCES OF NEGATIVE ACTION:
The Brentwood Sphere of Influence fee program will remain open and the agreement with the City of
Brentwood will not be terminated.
