RECOMMENDATION
1. APPROVE Change Order No. 1, in the amount of ' $184,192 with Siemens Building
Technologies, Inc. to add design-build turnkey installation of a steam boiler replacement at the
Juvenile Hall in Martinez.
2. AUTHORIZE the General Services Director, or designee, to execute the Change Order, which
provides for additional work and increases the payment limit by $184,192 for a total contract
amount of $1,502,065.
FINANCIAL IMPACT
The cost of Change Order No. 1, $184,192, will be funded through a lease purchase contract over 10
years within the budget of the General Services Department. The total cost of the original contract is
$1,317,873, funded with proceeds from an approved California Energy Commission (CEC) loan. The
loan is for a period of 15 years at 3.95% interest.
BACKGROUND
On March 18, 2008, the Board approved a contract in the amount of $1,317,873 with Siemens
Building Technologies, Inc. to provide design-build turnkey installations of a cogeneration plant and
lighting retrofits at Juvenile Hall in Martinez.
Siemens Building Technology, Inc. was selected for these projects pursuant to California Government
Code 4217.16. Government Code 4217.16 provides public entities the authority to sole-source award
energy conservation and alternate energy supply projects to energy services companies that are
intended to maximize energy savings potential. The contract is a Design-Build Turn-Key agreement
in that Siemens Building Technologies, Inca will be responsible for all aspects of the project including
project design, permitting, equipment acquisition, construction, construction management,
commissioning, and rebate submittals.

REPLACEMENT AT THE JUVENILE HALL IN MARTINEZ
The steam boiler at Juvenile Hall has reached its useful life and needs to be replaced. Change Order
No. 1 adds the work to replace the steam boiler to the original contract. Since the original contract to
install cogeneration includes significant work on the hot water and heating systems at Juvenile Hall, it
is advantageous to have this contractor include the boiler replacement. This greatly simplifies
coordination and improves efficiency and timeliness of the work. .

Dear Andy,
The following is a proposal to do a turnkey design-build installation services to include: Removal of
the Steam Boiler, steam heat exchanger, piping, insulation and other obsolete equipment affected
by the scope of this project.
This proposal is comprised of the following items:
1. Juvenile Hall Boiler Replacement
2. General Conditions and Exclusions
1. Juvenile Hall Boiler Replacement:
The scope of work will include the following:
• Turnkey design-build installation services
• Turnkey, design-build replacement of existing Steam Boiler system
• System shall include: 2.5MMBtu output nominal sized hot water system (size and number
of units will be determined during design)
• Installation of all necessary piping, insulation, valves, electrical wiring, conduit, disconnects
as required per all local and state codes
• New system to reuse existing flue venting, control system and components [Additional flue
ventilation duct or controls are not included in this price]
• Demolition of steam boiler, steam heat exchanger, piping, insulation,-and other obsolete
equipment affected by the scope of this project
• Site supervision and coordination of installation activities.
• Assistance with local building permits & related fees.
PRICE: $184,192.00
(One hundred eighty four thousand, one hundred and ninety two US Dollars)

2. General Conditions & Exclusions:
This proposal expires (60) sixty days from the date of this proposal
A warranty of(1) one year for parts and labor is included
All work will be completed in a workmanlike manner according to standard industry practices
• Sales tax and/or freight and shipping charges are included in the proposal price
(1) Operation & Maintenance manual with (2) hours of on-site training will be provided
• Any alteration or deviation from the above specifications involving extra cost of material or labor will
be executed upon written orders for same and will become an extra charge over the sum mentioned
in this contract.
Exclusions include the following:
o Hazardous waste removal or abatement
o Alteration, service, or repairs of equipment outside of the above listed scope of work
Please issue a change order for the above amount so as we can;proceed with the work.

Attached for your review and approval is a copy of Change Order No. I for the Contract with
Siemens Building Technologies, Inc. for the subject project. The effective date is June 24, 2008.
This will be required to go before the Board because the change order amount exceeds the Public
Contract Code maximum of S 150,000.
The project # is 000-0303 and the charge number is WH197T. This change order is required to do a
turnkey design-build installation of a new boiler at Juvenile Hall.
Please indicate your approval via e-mail or by signing and returning this memo via fax or interoffice
mail by June 5, 2008. The current contract which had been previously approved by the Board and
written by County Counsel is attached for reference, along with the copy of the Board Order.
